● Determination <strong>of</strong> whether an <strong>ACO</strong> is eligible for shared savings under section<br />

1899(d)(2) <strong>of</strong> the Act), the amount <strong>of</strong> shared savings, including the determination <strong>of</strong> the<br />

estimated average per capita Medicare expenditures under the <strong>ACO</strong> for Medicare FFS<br />

beneficiaries assigned to the <strong>ACO</strong> and the average benchmark for the <strong>ACO</strong> under section<br />

1899(d)(1)(B) <strong>of</strong> the Act.<br />

● Percent <strong>of</strong> shared savings specified by the Secretary under section 1899(d)(2)<br />

<strong>of</strong> the Act and any limit on the total amount <strong>of</strong> shared savings.<br />

● Termination <strong>of</strong> an <strong>ACO</strong> under section 1899(d)(4) <strong>of</strong> the Act for failure to meet<br />

quality performance standards.<br />

The statute is otherwise silent regarding an <strong>ACO</strong>'s right to contest decisions on<br />

such matters as eligibility to participate in the Shared Savings Program or termination for<br />

avoidance <strong>of</strong> at-risk beneficiaries. Accordingly, we believe it is important to establish a<br />

fair administrative process by which <strong>ACO</strong>s may request review <strong>of</strong> decisions, such as the<br />

denial <strong>of</strong> an <strong>ACO</strong> application or the termination <strong>of</strong> an existing <strong>ACO</strong> agreement for<br />

reasons other than those exempted by statute. An administrative reconsideration process<br />

provides an opportunity to resolve disputes quickly and efficiently, and creates an<br />

administrative record that can serve as the basis for any further review <strong>of</strong> the agency's<br />

decision.<br />

Based on our experiences with the Medicare durable medical equipment<br />

prosthetics orthotics and supplies (DMEPOS) competitive bidding program and the MA<br />

Part C and D programs, we are proposing to implement reconsideration review procedure<br />

similar to the review process used by those programs for initial determinations that are<br />

not precluded from administrative or judicial review by statute. These initial
