during the term <strong>of</strong> the agreement.<br />

§425.19 Data sharing with <strong>ACO</strong>s.<br />

(a) General rules. CMS shares both aggregate and beneficiary identifiable data with<br />

<strong>ACO</strong>s under the following general conditions:<br />

(1) The <strong>ACO</strong> does not unnecessary limitations or restrictions on the use or disclosure <strong>of</strong><br />

individually identifiable health information that it internally compiles from providers and<br />

suppliers both within and outside <strong>of</strong> the <strong>ACO</strong>.<br />

(2) The <strong>ACO</strong> observes all relevant statutory and regulatory provisions regarding the<br />

appropriate use <strong>of</strong> data and the confidentiality and privacy <strong>of</strong> individually identifiable health<br />

information and complies with the terms <strong>of</strong> the data use agreement described in paragraph (f) <strong>of</strong><br />

this section.<br />

(b) Sharing aggregate data. (1) CMS shares aggregate data (data that omits the 18<br />

identifiers listed at 45 CFR 164.514(b) with <strong>ACO</strong>s as follows:<br />

(i) Aggregate data reports at the start <strong>of</strong> the agreement period based on the historical<br />

beneficiaries used to calculate the benchmark, and each quarter thereafter during the agreement<br />

period.<br />

(ii) Quarterly reports will be based upon the most recent 12 months <strong>of</strong> data for<br />

beneficiaries that could potentially be assigned to the <strong>ACO</strong> under the assignment methodology in<br />

§425.6. These data will not include beneficiary identifying information, but will include deidentified<br />

claims history <strong>of</strong> the services rendered for the <strong>ACO</strong>'s assigned FFS beneficiaries, as<br />

determined under §425.6 <strong>of</strong> this part.<br />

(2) These aggregate data reports will include, when available, the following information:<br />

(i) Financial performance.
