Read more (b) morethan one gas-fired appliance each of which has the same supply of gas unlessthe gas supply for such appliances is shut off at the point where it leavesthe container or containers at all times when none of such appliances is inuse; or (c) morethan one gas-fired appliance each of which does not have the same supply ofgas unless each gas supply for such appliances is shut off at the point whereit leaves the container or containers at all times when none of such applianceswhich it supplies is in use. Use of gas-fired appliances when a vehicle is in motion 96.—(1) Subjectto paragraph (2), this regulation applies to every motor vehicle and trailer. (2) Paragraphs(3) and (4) do not apply to a vehicle constructed or adapted for the conveyanceof goods under controlled temperatures. (3) No personshall use, or cause or permit to be used, in any vehicle to which this paragraphapplies, while the vehicle is in motion on a road, any gas-fired applianceexcept— (a) agas-fired appliance which is fitted to engineering plant while the plant isbeing used for the purposes of the engineering operations for which it wasdesigned; (b) agas-fired appliance which is permanently attached to a bus, provided thatany appliance for heating or cooling the interior of the bus for the comfortof the driver and any passengers does not expose a naked flame on the outsideof the appliance; or (c) inany other vehicle, a refrigerating appliance or an appliance which does notexpose a naked flame on the outside of the appliance and which is permanentlyattached to the vehicle and designed for the purpose of heating any part ofthe interior of the vehicle for the comfort of the driver and any passengers. (4) No personshall use, or cause or permit to be used, in any vehicle to which this paragraphapplies, while the vehicle is in motion on a road, any gas-fired applianceto which— (a) sub-paragraph(3)(a) refers, unless the appliance complieswith the requirements specified in paragraphs 12 and 13 of Schedule 5 and the gas system to which it is attachedcomplies with the requirements specified in paragraphs 2 to 9and 15 of Schedule5; or (b) sub-paragraph(3)(b) refers, unless the appliance complieswith the requirements specified in paragraphs 12, 13 and 14 of Schedule5 and the gas system to which it is attachedcomplies with the requirements specified in paragraphs 2 to 9, 11 and 15 of Schedule 5;or (c) sub-paragraph(3)(c) refers, unless the appliance complies— (i) if it is fitted to a motor vehicle, with the requirements specified in paragraphs 12, 13 and 14 of Schedule 5;and (ii) in any other case, with the requirements specified in paragraphs 12 and 13 of Schedule 5; and the gas system to which the appliance is attached complieswith the requirements specified in paragraphs 2 to 9and 15 of Schedule5. (5) No personshall use, or cause or permit to be used, in a vehicle to which this regulationapplies which is in motion on a road any gas-fired appliance unless it isfitted with a valve which stops the supply of gas to the appliance if theappliance fails to perform its function and causes gas to be emitted. 106

No motor vehicle shall be used on a road in such manner as to causeany excessive noise which could have been avoided by the exercise of reasonablecare on the part of the driver. Stopping of engine when stationary 98.—(1) Save asprovided in paragraph (2), the driver of a vehicle shall, when the vehicleis stationary, stop the action of any machinery attached to or forming partof the vehicle so far as may be necessary for the prevention of noise. (2) The provisionsof paragraph (1) do not apply— (a) whenthe vehicle is stationary owing to the necessities of traffic; (b) soas to prevent the examination or working of the machinery where the examinationis necessitated by any failure or derangement of the machinery or where themachinery is required to be worked for a purpose other than driving the vehicle;or (c) inrespect of a vehicle propelled by gas produced in plant carried on the vehicle,to such plant. Use of audible warning instruments 99.—(1) Subjectto the following paragraphs, no person shall sound, or cause or permit tobe sounded, any horn, gong, bell or siren fitted to or carried on a vehiclewhich is— (a) stationaryon a road, at any time, other than at times of danger due to another movingvehicle on or near the road; or (b) inmotion on a restricted road, between 23.30 hours and 07.00 hours in the followingmorning. (2) The provisionsof paragraph (1)(a) do not apply in respectof the sounding of a reversing alarm when the vehicle to which it is fittedis about to move backwards and its engine is running. (3) No personshall sound, or cause or permit to be sounded, on a road any reversing alarmfitted to a vehicle— (a) unlessthe vehicle is a goods vehicle which has a maximum gross weight not less than2000 kg, a bus, engineering plant, or a works truck; or (b) ifthe sound of the alarm is likely to be confused with a sound emitted in theoperation of a pedestrian crossing established, or having effect as if established,under Part IIIof the 1984 Act. (4) Subjectto the provisions of the following paragraphs, no person shall sound, or causeor permit to be sounded a gong, bell, siren or two-tone horn, fitted to orotherwise carried on a vehicle (whether it is stationary or not). (5) Nothingin paragraph (1) or (4) shall prevent the sounding of— (a) aninstrument or apparatus fitted to, or otherwise carried on, a vehicle at atime when the vehicle is being used for one of the purposes specified in regulation 37(5) and it is necessaryor desirable to do so either to indicate to other road users the urgency ofthe purposes for which the vehicle is being used, or to warn other road usersof the presence of the vehicle on the road; or (b) ahorn (not being a two-tone horn), bell, gong or siren— 107
