Read more (c) in any other case, the weight which the axle is designedor adapted not to exceed when the vehicle is travelling on a road. “municipal vehicle”means a motor vehicle or trailer limited at all timesto use by a local authority, or a person acting in pursuance of a contractwith a local authority, for road cleansing, road watering or the collectionand disposal of refuse, night soil or the contents of cesspools, or the purposesof the enactments relating to weights and measures or the sale of food anddrugs. “multi-stop local collectionand delivery vehicle” means a motorvehicle or trailer used for multi-stop collection and delivery services tobe used only within a radius of 25 miles from the permanent base at whichit is normally kept. Mixing of tyres 26.—(1) Save asprovided in paragraph (5) pneumatic tyres of different types of structureshall not be fitted to the same axle of a wheeled vehicle. (2) Save asprovided in paragraphs (3) or (5), a wheeled motor vehicle having only twoaxles each of which is equipped with one or two single wheels shall not befitted with— (a) adiagonal-ply tyre or a bias-belted tyre on its rear axle if a radial-ply tyreis fitted on its front axle; or (b) adiagonal-ply tyre on its rear axle if a bias-belted tyre is fitted on thefront axle. (3) Paragraph(2) does not apply to a vehicle to an axle of which there are fitted widetyres not specially constructed for use on engineering plant or to a vehiclewhich has a maximum speed not exceeding 30 mph. (4) Save asprovided in paragraph (5) pneumatic tyres fitted to— (a) thesteerable axles of a wheeled vehicle; and (b) thedriven axles of a wheeled vehicle, not being steerable axles, shall all be of the same type of structure. (5) Paragraphs(1), (2), and (4) do not prohibit the fitting of a temporary use spare tyreto a wheel of a passenger vehicle (not being a bus) unless it is driven ata speed exceeding 50 mph. (6) In thisregulation— “axle” includes— (i) (ii) two or more stub axles which are fitted on oppositesides of the longitudinal axis of the vehicle so as to form— (1) a pair in the case of two stub axles; and (2) pairs in the case of more than two stub axles; and a single stub axle which is not one of a pair; “a bias-belted tyre”means a pneumatic tyre, the structure of which is suchthat the ply cords extend to the bead so as to be laid at alternate anglesof substantially less than 90 degrees to the peripheral line of the tread,and are constrained by a circumferential belt comprising two or more layersof substantially inextensible cord material laid at alternate angles smallerthan those of the ply cord structure; “a diagonal-ply tyre”means a pneumatic tyre, the structure of which is suchthat the ply cords extend to the bead so as to be laid at alternate anglesof substantially less than 90 degrees to the peripheral line of the tread,but not being a bias-belted tyre; “a driven axle”means an axle through which power is transmitted fromthe engine of a vehicle to the wheels on that axle; 42

Read more “a radial-ply tyre”means a pneumatic tyre, the structure of which is suchthat the ply cords extend to the bead so as to be laid at an angle of substantially90 degrees to the peripheral line of the tread, the ply cord structure beingstabilised by a substantially inextensible circumferential belt; “stub axle” means an axle on which only one wheel is mounted; and “type of structure”,in relation to a tyre, means a type of structure ofa tyre of a kind defined in the foregoing provisions of this paragraph. Condition and maintenance of tyres 27.—(1) Save asprovided in paragraphs (2), (3) and (4), a wheeled motor vehicle or trailera wheel of which is fitted with a pneumatic tyre shall not be used on a road,if— (a) thetyre is unsuitable having regard to the use to which the motor vehicle ortrailer is being put or to the types of tyres fitted to its other wheels; (b) thetyre is not so inflated as to make it fit for the use to which the motor vehicleor trailer is being put; (c) thetyre has a cut in excess of 25 mm or 10% of the section width of the tyre,whichever is the greater, measured in any direction on the outside of thetyre and deep enough to reach the ply or cord; (d) thetyre has any lump, bulge or tear caused by separation or partial failure ofits structure; (e) thetyre has any of the ply or cord exposed; (f) thebase of any groove which showed in the original tread pattern of the tyreis not clearly visible; (g) either— (i) the grooves of the tread pattern of the tyre do not have a depth of at least1 mm throughout a continuous band measuring at least three-quarters of thebreadth of the tread and round the entire outer circumference of the tyre;or (ii) if the grooves of the original tread pattern of the tyre did not extend beyondthreequarters of the breadth of the tread, any groove which showed in theoriginal tread pattern does not have a depth of at least 1 mm; or (h) thetyre is not maintained in such condition as to be fit for the use to whichthe vehicle or trailer is being put or has a defect which might in any waycause damage to the surface of the road or damage to persons on or in thevehicle or to other persons using the road. (2) Paragraph(1) does not prohibit the use on a road of a motor vehicle or trailer by reasononly of the fact that a wheel of the vehicle or trailer is fitted with a tyrewhich is deflated or not fully inflated and which has any of the defects describedin sub-paragraph (c), (d) or (e) of paragraph (1),if the tyre and the wheel to which it is fitted are so constructed as to makethe tyre in that condition fit for the use to which the motor vehicle or traileris being put and the outer sides of the wall of the tyre are so marked asto enable the tyre to be identified as having been constructed to comply withthe requirements of this paragraph. (3) Paragraph(1)(a) does not prohibit the use on a roadof a passenger vehicle (not being a bus) by reason only of the fact that awheel of the vehicle is fitted with a temporary use spare tyre, unless thevehicle is driven at a speed exceeding 50 mph. (a) Nothingin paragraph (1)(a) to (g) applies to— (i) an agricultural motor vehicle that is not driven at more than 20 mph; (ii) an agricultural trailer; (iii) an agricultural trailed appliance; or 43
