14. Public Services Ombudsman (Wales) Bill [hl]—It was moved by the Lord Evans of Temple Guiting<br />

that the amendments for the Report stage be marshalled and considered in the following<br />

order:<br />

Clauses 2 to 10 Schedule 5<br />

the motion was agreed to.<br />

15. Disability Discrimination Bill [hl]—The bill was further considered on report; an amendment was<br />

agreed to (see division list 1); amendments were moved and (by leave of the House) withdrawn;<br />

an amendment was agreed to; it was ordered that the bill be printed as amended. (HL Bill 25)<br />

16. Inquiries Bill [hl]—The bill was further considered on report; amendments were moved and (by<br />

leave of the House) withdrawn; amendments were agreed to; an amendment was disagreed to<br />

(see division list 2); it was ordered that the bill be printed as amended. (HL Bill 26)<br />

17. Mental Capacity Bill—The House again resolved itself into a Committee upon the bill;<br />

amendments were moved and (by leave of the Committee) withdrawn; the House was resumed<br />

and the bill was reported with amendments; it was ordered that the bill be printed as amended.<br />

18. Children (Contact) and Adoption Bill, Draft—A message was brought from the Commons that<br />

they concur with the Lords that it is expedient that a Joint Committee of Lords and Commons<br />

be appointed to consider and report on any draft Children (Contact) and Adoption Bill<br />

presented to both Houses by a Minister of the Crown, and that the Committee should report<br />

on the draft Bill by 26th May 2005, and have ordered:<br />

That a Select Committee of six honourable Members be appointed to join with the Committee<br />

appointed by the Lords to consider the draft Children (Contact) and Adoption Bill;<br />

That the Committee shall have power—<br />

(i) to send for persons, papers and records;<br />

(ii) to sit notwithstanding any adjournment of the House;<br />

(iii) to report from time to time;<br />

(iv) to appoint specialist advisers;<br />

(v) to adjourn from place to place within the <strong>United</strong> <strong>Kingdom</strong>; and<br />

That the quorum of the Committee shall be two.<br />

The House was adjourned at sixteen minutes before eleven o’clock<br />

till tomorrow, half-past two o’clock.<br />

It was moved by the Lord Skelmersdale in Clause 17, page 42, line 32, at end to insert:<br />

“( ) In paragraph 2, after sub-paragraph (2) there is inserted—<br />

“( ) Without prejudice to the operation of sub-paragraph (2), the mental impairment consisting of or<br />

resulting from depression that has ceased to have a substantial adverse eVect on a person’s ability to<br />

carry out normal day to day activities shall always be treated as if that eVect is likely to recur if the person<br />

has had within the last 5 years a previous episode of such impairment which had a substantial adverse<br />

eVect on the person’s ability to carry out normal day to day activities for a period of 6 months or<br />

more.””;<br />
