phone directory. All active demonstrators who opt in are part<br />

of the <strong>Demonstrator</strong> Directory. (A demonstrator opts in to be<br />

part of the <strong>Demonstrator</strong> Directory on the <strong>Demonstrator</strong> Web<br />

Site.) A demonstrator does not need to have a <strong>Demonstrator</strong><br />

Business Web Site (DBWS) in order to be listed on the<br />

<strong>Demonstrator</strong> Directory.<br />

Once potential customers or recruits find a demonstrator<br />

using the <strong>Demonstrator</strong> Locator or <strong>Demonstrator</strong> Directory,<br />

they can then choose whether they want Stampin’ <strong>Up</strong>! to refer<br />

their name and contact information to the demonstrator or<br />

whether they want to contact the demonstrator themselves.<br />

If the referral prefers to be contacted by the demonstrator,<br />

Stampin’ <strong>Up</strong>! will send the customer’s contact information to<br />

the demonstrator via Stampin’ Mail. Stampin’ <strong>Up</strong>! does not<br />

investigate or otherwise screen potential customers or recruits<br />

prior to referring them to participating demonstrators.<br />

How the <strong>Demonstrator</strong> Directory and<br />

<strong>Demonstrator</strong> Locator Work with Commissions<br />

on Online Sales<br />

The percentage of commission you earn on online sales<br />

depends on whether you have a DBWS.<br />

Here are a few scenarios to explain how this works:<br />

• If a customer visits www.stampinup.com, chooses you<br />

from the <strong>Demonstrator</strong> Locator (because you have a<br />

DBWS), and makes a purchase, you will receive your<br />

regular 20 percent deferred income on the net sales of<br />

that purchase. You will have the total order amount<br />

credited to you as sales.<br />

• If a customer visits www.stampinup.com and wants<br />

to find a demonstrator near her—and you don’t have<br />

a DBWS—she won’t be able to find you using the<br />

<strong>Demonstrator</strong> Locator because you don’t have a DBWS.<br />

(Having a DBWS is one of the requirements for being<br />

listed in the <strong>Demonstrator</strong> Locator.) If she is looking<br />

for you specifically, however, she can find you in the<br />

<strong>Demonstrator</strong> Directory. If she chooses you from the<br />

<strong>Demonstrator</strong> Directory, and makes a purchase, you will<br />

receive 10 percent (versus 20 percent) deferred income<br />

on the net sales on that purchase. You will still have the<br />

total order amount credited to you as sales.<br />

Enforcement of Company<br />

Policies Policy<br />

Stampin’ <strong>Up</strong>! reserves the right to enforce its policies as<br />

explained in the <strong>Demonstrator</strong> <strong>Manual</strong> and other Stampin’<br />

<strong>Up</strong>! publications (including the Stampin’ <strong>Up</strong>! Web Site).<br />

Additionally, changes to existing policies as published by<br />

Stampin’ <strong>Up</strong>! are enforceable according to the following<br />

guidelines. <strong>Demonstrator</strong>s have the right to appeal the<br />

company’s decision as explained herein.<br />

Informal Resolution Process<br />

In most situations, concerns or disputes about possible<br />

violations of the Independent <strong>Demonstrator</strong> Agreement, the<br />

<strong>Demonstrator</strong> <strong>Manual</strong>, or any other published policy of the<br />

company will be handled initially on an informal basis by<br />

the Stampin’ <strong>Up</strong>! compliance department. This department,<br />

assisted by selected members of the Stampin’ <strong>Up</strong>! management<br />

staff (collectively the Compliance Committee), is responsible<br />

for maintaining compliance with the terms of the Independent<br />

<strong>Demonstrator</strong> Agreement and the <strong>Demonstrator</strong> <strong>Manual</strong> as<br />

well as reconciling disputes among demonstrators.<br />

If a company employee or another demonstrator detects a<br />

violation by a demonstrator of the terms of the Independent<br />

<strong>Demonstrator</strong> Agreement or the <strong>Demonstrator</strong> <strong>Manual</strong>,<br />

she should first discuss the matter with the alleged offender.<br />

Most violations are caused by simple lack of information.<br />

Pointing out the appropriate section in the Independent<br />

<strong>Demonstrator</strong> Agreement or the <strong>Demonstrator</strong> <strong>Manual</strong> is<br />

usually enough to resolve the matter. If a violation persists,<br />

the employee or demonstrator who discovered the violation<br />

should lodge a complaint in writing with the Stampin’ <strong>Up</strong>!<br />

compliance department. The compliance department will<br />

investigate the matter and determine if the violation warrants<br />

disciplinary action. In most cases, if a disciplinary action is<br />

needed, the compliance department will attempt to secure<br />

the cooperation of the violating demonstrator in conforming<br />

to appropriate Stampin’ <strong>Up</strong>! policies and procedures. Under<br />

certain circumstances, Stampin’ <strong>Up</strong>! reserves the right to move<br />

straight to the Formal Resolution process without attempting<br />

to resolve the issue informally.<br />

Formal Resolution Process<br />

In the Formal Resolution process, the compliance supervisor<br />

will send the violating demonstrator a letter outlining the<br />

issues of the case and the date, time, and place of a hearing<br />

on the matter. A copy of the letter will also be sent to the<br />

president of the company (“President”). At the hearing, the<br />

compliance supervisor, with the majority approval of the<br />

Compliance Committee, may recommend to the President<br />

action to remedy the situation. Taking action may involve<br />
