its PHI products were broken, such that consumers could keep <strong>the</strong>ir<br />

multi-trip travel <strong>in</strong>surance if <strong>the</strong>y switched to ano<strong>the</strong>r PHI provider.<br />

6.54 The F<strong>in</strong>ancial Regulator’s Consumer Protection Code states that “A<br />

regulated entity must not make <strong>the</strong> sale of a product or service<br />

cont<strong>in</strong>gent on <strong>the</strong> consumer purchas<strong>in</strong>g ano<strong>the</strong>r product or service<br />

from <strong>the</strong> regulated entity.” Vhi <strong>Health</strong>care is subject to this code as an<br />

<strong>in</strong>termediary (on which basis it sells travel <strong>in</strong>surance policies) but not<br />

as an <strong>in</strong>surer (on which basis it sells <strong>the</strong> policies on which <strong>the</strong> sale of<br />

travel <strong>in</strong>surance is cont<strong>in</strong>gent). The Authority has raised this matter<br />

with <strong>the</strong> F<strong>in</strong>ancial Regulator and <strong>in</strong>tends to discuss it fur<strong>the</strong>r with <strong>the</strong>m<br />

<strong>in</strong> <strong>the</strong> near future <strong>in</strong> order to determ<strong>in</strong>e whe<strong>the</strong>r Vhi <strong>Health</strong>care is<br />

act<strong>in</strong>g <strong>in</strong> breach of <strong>the</strong> Code.<br />

6.55 If Vhi <strong>Health</strong>care is act<strong>in</strong>g <strong>in</strong> breach of <strong>the</strong> F<strong>in</strong>ancial Regulator’s Code<br />

of Conduct by mak<strong>in</strong>g <strong>the</strong> sale of travel <strong>in</strong>surance cont<strong>in</strong>gent on <strong>the</strong><br />

sale of o<strong>the</strong>r products that it provides <strong>the</strong>n Vhi <strong>Health</strong>care should alter<br />

its practices <strong>in</strong> order to comply with <strong>the</strong> Code.<br />

6.56 However, it may be that Vhi <strong>Health</strong>care is not <strong>in</strong> breach of <strong>the</strong> code<br />

because it is not regulated by <strong>the</strong> F<strong>in</strong>ancial Regulator as a provider of<br />

private health <strong>in</strong>surance. If this is <strong>the</strong> case it constitutes an advantage<br />

for Vhi <strong>Health</strong>care as a result of its particular regulatory position.<br />

While <strong>the</strong> Authority recommends that Vhi <strong>Health</strong>care become subject<br />

to regulation by <strong>the</strong> F<strong>in</strong>ancial Regulator as an <strong>in</strong>surer, this will take<br />

some time. In <strong>the</strong> meantime Vhi <strong>Health</strong>care should operate <strong>in</strong><br />

accordance with <strong>the</strong> terms of <strong>the</strong> F<strong>in</strong>ancial Regulator’s Consumer<br />

Protection Code when sell<strong>in</strong>g travel <strong>in</strong>surance.<br />

Recommendation 12<br />

Vhi <strong>Health</strong>care should comply with <strong>the</strong> F<strong>in</strong>ancial<br />

Regulator’s Consumer Protection Code as if Vhi<br />

<strong>Health</strong>care was a regulated entity of <strong>the</strong> F<strong>in</strong>ancial<br />

Regulator.<br />

M<strong>in</strong>isterial approval for products for sale by Vhi<br />

<strong>Health</strong>care should only be given where it would not<br />

lead to a breach of <strong>the</strong> F<strong>in</strong>ancial Regulator’s Consumer<br />

Protection Code.<br />

6.57 Care needs to be taken <strong>in</strong> implement<strong>in</strong>g this recommendation. If a<br />

consumer ceases to hold a PHI policy with any PHI firm, but cont<strong>in</strong>ues<br />

to hold Vhi MultiTrip <strong>in</strong>surance, <strong>the</strong>y will not be covered for <strong>the</strong> sum<br />

orig<strong>in</strong>ally <strong>in</strong>sured under <strong>the</strong>ir PHI policy, and will be personally liable<br />

for sums <strong>in</strong> this amount. Accord<strong>in</strong>gly, consumers should be made<br />

aware before cancell<strong>in</strong>g <strong>the</strong>ir PHI policy that failure to secure ano<strong>the</strong>r<br />

PHI policy will leave <strong>the</strong>m potentially liable to such expenses for <strong>the</strong><br />

rema<strong>in</strong>der of <strong>the</strong> lifetime of <strong>the</strong>ir Vhi MultiTrip policy.<br />

M<strong>in</strong>imum Benefit Regulations<br />

6.58 The M<strong>in</strong>imum Benefits Regulations limit <strong>in</strong>novation and restrict<br />

competition on <strong>the</strong> merits of product offer<strong>in</strong>gs by forc<strong>in</strong>g PHI firms to<br />

cover certa<strong>in</strong> procedures and hospitals. However, <strong>the</strong> M<strong>in</strong>imum Benefit<br />
