to its exemption under Art. 4(c) from <strong>the</strong> 1973 EU First Non-Life<br />

<strong>Insurance</strong> Directive, Vhi <strong>Health</strong>care is exempt from regulation by <strong>the</strong><br />

F<strong>in</strong>ancial Regulator as an <strong>in</strong>surance undertak<strong>in</strong>g. This allows it to act<br />

on <strong>the</strong> market <strong>in</strong> ways that are unavailable to its competitors as<br />

regards its corporate governance, structure and prudential obligations.<br />

4.19 Vhi <strong>Health</strong>care is authorised by <strong>the</strong> F<strong>in</strong>ancial Regulator as a multiagency<br />

<strong>in</strong>termediary, and may <strong>in</strong>termediate <strong>in</strong> <strong>in</strong>surance o<strong>the</strong>r than<br />

PHI underwritten by o<strong>the</strong>r firms. It has broker arrangements <strong>in</strong> place<br />

with DeCare Dental and Europ Assistance for <strong>the</strong> provision of dental<br />

<strong>in</strong>surance and <strong>in</strong>ternational health plans respectively. Vhi <strong>Health</strong>care<br />

may also sell non-<strong>in</strong>surance products. For example, Vhi <strong>Health</strong>care’s<br />

onl<strong>in</strong>e shop sells products as diverse as foot spas and rugby jerseys. 43<br />

The only solvency requirements which apply to it are those which apply<br />

to it by virtue of its capacity as an <strong>in</strong>surance <strong>in</strong>termediary. However,<br />

its f<strong>in</strong>ancial affairs are regulated <strong>in</strong> important respects by <strong>the</strong> VHI Acts.<br />

4.20 Vhi <strong>Health</strong>care’s health <strong>in</strong>surance and <strong>in</strong>termediary bus<strong>in</strong>esses fall<br />

with<strong>in</strong> <strong>the</strong> remit of <strong>the</strong> F<strong>in</strong>ancial Services Ombudsman.<br />

4.21 As a statutory body, Vhi <strong>Health</strong>care can only operate <strong>in</strong> a manner<br />

permitted by its govern<strong>in</strong>g legislation 44 . For <strong>in</strong>stance,<br />

• It is not allowed to establish subsidiary or sister companies,<br />

• It is statutorily restricted as regards its f<strong>in</strong>anc<strong>in</strong>g,<br />

• It is only allowed to underwrite health <strong>in</strong>surance contracts,<br />

• Legislation permits Vhi <strong>Health</strong>care only to engage <strong>in</strong> o<strong>the</strong>r health<br />

related <strong>in</strong>surance activities on an agency basis. and<br />

• It must notify <strong>the</strong> M<strong>in</strong>ister of price <strong>in</strong>creases <strong>in</strong> its health <strong>in</strong>surance<br />

products and <strong>the</strong> M<strong>in</strong>ister has <strong>the</strong> power to reject a price <strong>in</strong>crease.<br />

4.22 Under <strong>the</strong> Voluntary <strong>Health</strong> <strong>Insurance</strong> Act 1957, Vhi <strong>Health</strong>care is<br />

restricted <strong>in</strong> terms of <strong>the</strong> categories of bus<strong>in</strong>ess which it is allowed<br />

provide. 47 The Voluntary <strong>Health</strong> <strong>Insurance</strong> (Amendment) Act 1996<br />

extended <strong>the</strong> types of health <strong>in</strong>surance scheme that Vhi <strong>Health</strong>care<br />

could offer. The Voluntary <strong>Health</strong> <strong>Insurance</strong> (Amendment) Act 1998<br />

permitted Vhi <strong>Health</strong>care to act as an agent for an <strong>in</strong>ternational health<br />

plan. This allowed it to add medical cover while abroad as an additional<br />

benefit to its core PHI product. The <strong>Health</strong> <strong>Insurance</strong> (Amendment) Act<br />

2001 allowed Vhi <strong>Health</strong>care to provide health related services, but<br />

only with <strong>the</strong> consent of <strong>the</strong> M<strong>in</strong>ister.<br />

4.23 The follow<strong>in</strong>g table, taken from <strong>the</strong> F<strong>in</strong>ancial Regulator’s submission,<br />

<strong>in</strong>dicates <strong>the</strong> variations <strong>in</strong> regulation of PHI firms:<br />
