Recommendation 2<br />

In <strong>the</strong> context of <strong>the</strong> commencement of risk<br />

equalisation payments, Vhi <strong>Health</strong>care should be<br />

required to satisfy <strong>the</strong> relevant prudential solvency<br />

requirements as soon as is feasible. The proposed<br />

six-year timeframe allowed for Vhi <strong>Health</strong>care to<br />

atta<strong>in</strong> <strong>the</strong> necessary level of reserves should be<br />

reviewed with a view to shorten<strong>in</strong>g it. Consideration<br />

should be given to methods of rais<strong>in</strong>g capital o<strong>the</strong>r<br />

than through <strong>the</strong> accumulation of surplus.<br />

Recommendation 3<br />

Vhi <strong>Health</strong>care should be subject to prudential<br />

regulation <strong>in</strong> its capacity as a PHI undertak<strong>in</strong>g by <strong>the</strong><br />

F<strong>in</strong>ancial Regulator. Vhi <strong>Health</strong>care’s exemptions from<br />

<strong>the</strong> First and Third EU Non-Life <strong>Insurance</strong> Directives<br />

should be abolished. The M<strong>in</strong>ister for <strong>Health</strong> and<br />

Children should seek <strong>the</strong> removal of <strong>the</strong>se exemptions<br />

by <strong>the</strong> <strong>in</strong>stitutions of <strong>the</strong> EU once Vhi <strong>Health</strong>care is <strong>in</strong><br />

a position to receive authorisation as an <strong>in</strong>surer.<br />

Recommendation 4<br />

The requirement for M<strong>in</strong>isterial approval for Vhi<br />

<strong>Health</strong>care premium <strong>in</strong>creases under S.3 of <strong>the</strong><br />

Voluntary <strong>Health</strong> <strong>Insurance</strong> (Amendment) Act, 1996<br />

should be removed, once Vhi <strong>Health</strong>care’s exemptions<br />

from <strong>the</strong> Non-Life <strong>Insurance</strong> Directives are removed.<br />

At that stage, consideration should be given to<br />

whe<strong>the</strong>r it is appropriate to cont<strong>in</strong>ue price regulation<br />

by an <strong>in</strong>dependent regulatory body.<br />

4.39 The <strong>Health</strong> <strong>Insurance</strong> Acts (1994 to 2003) and associated regulations<br />

legislate for community rat<strong>in</strong>g, open enrolment, lifetime cover,<br />

m<strong>in</strong>imum benefit and risk equalisation, all of which were described <strong>in</strong><br />

Chapter 2. They also specify <strong>the</strong> requirements and process for<br />

registration of private health <strong>in</strong>surance firms and set out <strong>the</strong> functions<br />

of The <strong>Health</strong> <strong>Insurance</strong> Authority.<br />

Registration of <strong>Private</strong> <strong>Health</strong> <strong>Insurance</strong> Firms<br />

4.40 The registration process for a health <strong>in</strong>surer is quite straightforward.<br />

Any <strong>in</strong>surance company that is authorised by <strong>the</strong> F<strong>in</strong>ancial Regulator or<br />

a counterpart regulator <strong>in</strong> ano<strong>the</strong>r EU member state to provide health<br />

<strong>in</strong>surance is entitled to be entered on <strong>the</strong> register of health <strong>in</strong>surers. A<br />

registered health <strong>in</strong>surer is obliged to ensure that its <strong>in</strong>surance<br />

products and processes comply with health <strong>in</strong>surance legislation. This<br />

obligation applies equally to all registered health <strong>in</strong>surers whatever<br />

<strong>the</strong>ir EU home state for <strong>in</strong>surance regulation purposes.<br />
