3. Whistleblowers Protection<br />

Act 2001<br />

The <strong>University</strong> is committed to ensuring full<br />

compliance with the aims and objectives<br />

<strong>of</strong> the Whistleblowers Protection Act 2001<br />

(The Act). It tolerates neither improper<br />

conduct by <strong>University</strong> staff and Council<br />

members nor the taking <strong>of</strong> reprisals against<br />

those who come forward to disclose such<br />

conduct.<br />

The <strong>University</strong> recognises the value <strong>of</strong><br />

transparency and accountability in its<br />

administrative and management practices<br />

and supports the making <strong>of</strong> disclosures<br />

that reveal corrupt conduct, conduct<br />

involving a substantial mismanagement <strong>of</strong><br />

public resources, or conduct involving a<br />

substantial risk to public health and safety<br />

or the environment.<br />

The <strong>University</strong> will take all reasonable<br />

steps to protect people who make such<br />

disclosures from any detrimental action in<br />

reprisal for making the disclosure. It will<br />

also afford natural justice to any person<br />

who is the subject <strong>of</strong> the disclosure.<br />

The <strong>University</strong>’s procedures for <strong>report</strong>ing<br />

disclosures <strong>of</strong> improper conduct or<br />

detrimental action by the <strong>University</strong>, its<br />

staff or members <strong>of</strong> Council were updated<br />

in October <strong>2007</strong>, and can be viewed at<br />

www.hr.unimelb.edu.au/advicesupport/<br />

whistleblowers.<br />

The procedures enable disclosures to<br />

be made to the Protected Disclosure<br />

Coordinator or to one <strong>of</strong> the nominated<br />

Protected Disclosure Officers listed on<br />

the website. Disclosures may be made by<br />

students, staff members or by members <strong>of</strong><br />

the public.<br />

made to the public body during the<br />

year: Nil.<br />

> The number <strong>of</strong> disclosures referred<br />

during the year by the public body to<br />

the Ombudsman for determination as<br />

to whether they were public interest<br />

disclosures: One public interest<br />

disclosure, <strong>report</strong>ed in 2006, was<br />

resolved in <strong>2007</strong> to the satisfaction <strong>of</strong><br />

the Ombudsman.<br />

> The number and types <strong>of</strong> disclosed<br />

matters referred to the public body during<br />

the year by the Ombudsman: Nil.<br />

> The number and types <strong>of</strong> disclosed<br />

matters referred during the year by<br />

the public body to the Ombudsman to<br />

investigate: Nil.<br />

> The number and types <strong>of</strong> investigations<br />

<strong>of</strong> disclosed matters taken over by the<br />

Ombudsman from the public body during<br />

the year: Nil.<br />

> The number <strong>of</strong> requests made under<br />

section 74 during the year to the<br />

Ombudsman to investigate disclosed<br />

matters: Nil.<br />

> The number and types <strong>of</strong> disclosed<br />

matters the public body had declined to<br />

investigate during the year: Nil.<br />

> The number and types <strong>of</strong> disclosed<br />

matters substantiated on investigation<br />

and the action taken on completion <strong>of</strong> the<br />

investigation: Nil.<br />

> The number <strong>of</strong> recommendations <strong>of</strong> the<br />

Ombudsman under this Act that related<br />

to the public body: In relation to one<br />

protected disclosure which commenced<br />

in 2006, the Ombudsman found no<br />

evidence <strong>of</strong> detrimental action by the<br />

<strong>University</strong>, but made recommendations<br />

on procedures for handling complaints,<br />

which the <strong>University</strong> has implemented.<br />

Grievance Procedures<br />

The <strong>University</strong> developed a set <strong>of</strong> student<br />

grievance procedures in 2003, taking into<br />

account comments from the Victorian<br />

Government review <strong>of</strong> governance<br />

in universities. The procedures were<br />

reviewed again in early 2004 in the<br />

light <strong>of</strong> some experience at using them<br />

and were amended to include some<br />

clarification about further processes <strong>of</strong><br />

appeal to outside bodies. The current<br />

student grievance procedures are on the<br />

<strong>University</strong>’s web site at<br />

www.services.unimelb.edu.au/grievances/<br />

The grievance procedures in the <strong>University</strong><br />

<strong>of</strong> <strong>Melbourne</strong> 2006 Enterprise Bargaining<br />

Agreement apply to all staff grievances,<br />

except where specific procedures exist.<br />

Specific processes exist for handling<br />

grievances relating to sexual harassment<br />

or unlawful discrimination. Staff members<br />

may also be aggrieved by decisions made<br />

by the <strong>University</strong> in relation to promotion,<br />

reclassification <strong>of</strong> general staff positions<br />

and disciplinary penalties for misconduct<br />

and unsatisfactory performance. Specific<br />

review committees exist to handle each<br />

<strong>of</strong> these issues. Current staff grievance<br />
