Excavation within existing <strong>road</strong> reserves shall be backfilled as soon as is reasonably practicable <strong>and</strong><br />

any unattended excavation shall be protected by suitable barricades, lights, signs <strong>and</strong> detours. The<br />

Contractor shall allow to maintain at all times access to each property within the <strong>road</strong> reserve together<br />

with free Public thoroughfare <strong>of</strong> the <strong>road</strong>way. The Contractor shall bear all costs <strong>and</strong> charges related<br />

to the provisions <strong>of</strong> warning signs, barricades, flagmen <strong>and</strong> lights. The Contractor shall obtain all<br />

necessary approvals from Public Utility Authorities, Local Authorities <strong>and</strong> other involved bodies <strong>and</strong><br />

shall comply with all provisions <strong>and</strong> conditions rendered with such approvals.<br />

Road pavements damaged or excavated shall be reinstated to the Local Authority requirements. The<br />

Contractor shall allow <strong>for</strong> all costs associated with such reinstatement.<br />

Certification by the Local Authority that all reinstatement has been undertaken or that arrangements<br />

have been made to their satisfaction <strong>for</strong> such reinstatement, will be required at Practical Completion.<br />

PUBLIC UTILITIES<br />

The Contractor shall be entirely responsible <strong>for</strong> the location <strong>and</strong> protection <strong>of</strong> all Public Utilities <strong>and</strong><br />

services be<strong>for</strong>e any <strong>works</strong> are commenced regardless <strong>of</strong> the utility being shown or not shown on the<br />

drawings. Repair <strong>and</strong> reinstatement costs arising from damage to any Public Utility due to the<br />

Contractor's activities shall be borne by the Contractor together with all costs arising from delays<br />

caused by such damage.<br />

The Contractor shall arrange <strong>for</strong> any supervision <strong>and</strong> approval required by any Public Utility in<br />

connection with any <strong>works</strong> on or adjacent to existing services.<br />

NUISANCE<br />

The Contractor shall take all reasonable measures to limit nuisance to the Public arising from<br />

operations regardless <strong>of</strong> the source <strong>of</strong> such nuisance.<br />

In respect to noise, the Contractor shall ensure the level <strong>of</strong> noise, when measured in accordance with<br />

the Local Authority By-laws <strong>and</strong> regulations, shall not exceed the maximum permissible level<br />

permitted by such By-Laws <strong>and</strong> Regulations. Where any machine or any operation cannot be<br />

conducted within the prescribed limits the Contractor shall cease such operation or remove such<br />

machine from site. The cost <strong>of</strong> all noise attenuation measures shall be borne by the Contractor.<br />

The Contractor shall allow <strong>for</strong> all reasonable measures, to limit nuisance caused by <strong>construction</strong><br />

traffic, dust, s<strong>and</strong>, smoke, vibration, light spill or other intrusion arising from the contract operations.<br />

EXISTING AREA DRAINAGE<br />

The Contractor shall allow <strong>for</strong> the maintenance <strong>and</strong> efficient operation <strong>of</strong> the existing <strong>drainage</strong> pattern<br />

<strong>and</strong> shall on completion <strong>of</strong> the Contract clean out <strong>and</strong> remove from the <strong>drainage</strong> system, regardless<br />

<strong>of</strong> source, any rubbish, debris or other deleterious matter deposited in the <strong>drainage</strong> system.<br />
