2 Registrati<strong>on</strong> obligati<strong>on</strong>s<br />
2.1 Who has to register?<br />
Aim:<br />
The aim of this chapter is to explain which actors have registrati<strong>on</strong> obligati<strong>on</strong>s<br />
and resp<strong>on</strong>sibilities under REACH.<br />
Structure: The structure of this chapter is as follows:<br />
2.1.1 Roles under REACH<br />
The obligati<strong>on</strong> to register a substance applies <strong>on</strong>ly to certain actors established in the EU.<br />
Before explaining the obligati<strong>on</strong>s of registrants, it is important to have a clear understanding<br />
<strong>on</strong> the different roles a company may have under the REACH Regulati<strong>on</strong>.<br />
One legal entity (see secti<strong>on</strong> 2.1.2.1) may have various roles depending <strong>on</strong> its activities, even<br />
for the same substance (e.g. manufacturer and importer). Therefore, it is very important<br />
that companies correctly identify their role or roles in the supply chain for each<br />
substance they handle, because this will be a decisive factor in determining their<br />
registrati<strong>on</strong> obligati<strong>on</strong>s.<br />
The following roles may be adopted in the c<strong>on</strong>text of REACH:<br />
Manufacturer: means any natural or legal pers<strong>on</strong> established within the EU who<br />
manufactures a substance within the EU (Article 3(9)).<br />
Manufacturing: means producti<strong>on</strong> or extracti<strong>on</strong> of substances in the natural state (Article<br />
3(8)).<br />
