<str<strong>on</strong>g>Guidance</str<strong>on</strong>g> <strong>on</strong> registrati<strong>on</strong><br />

which were substances not appearing <strong>on</strong> the European Inventory of Existing Commercial<br />

Chemical Substances (EINECS). The EINECS list c<strong>on</strong>tains, in principle, all substances <strong>on</strong> the<br />

Community market <strong>on</strong> 18 September 1981.<br />

Notificati<strong>on</strong>s made in accordance with Directive 67/548/EEC c<strong>on</strong>tain much of the technical<br />

dossier informati<strong>on</strong> which the REACH Regulati<strong>on</strong> aims to have assembled by registrants<br />

through the registrati<strong>on</strong> requirement. This is the reas<strong>on</strong> why such notificati<strong>on</strong>s are<br />

regarded as registrati<strong>on</strong>s. Notified substances according to Directive 67/548/EEC are<br />

generally referred to as NONS (Notificati<strong>on</strong> of New Substances) in the c<strong>on</strong>text of REACH.<br />

<strong>ECHA</strong> has assigned registrati<strong>on</strong> numbers to all notificati<strong>on</strong>s and distributes them electr<strong>on</strong>ically<br />

up<strong>on</strong> request of the notificati<strong>on</strong>’s owner. Detailed instructi<strong>on</strong>s <strong>on</strong> how to request a registrati<strong>on</strong><br />

number for a notified substance is available <strong>on</strong> the <strong>ECHA</strong> website at<br />

http://echa.europa.eu/web/guest/support/dossier-submissi<strong>on</strong>-tools/reach-it/n<strong>on</strong>s. Please, note<br />

that the registrati<strong>on</strong> is assigned for the t<strong>on</strong>nage band referred to in the notificati<strong>on</strong> of the<br />

substance. As so<strong>on</strong> as the actual volume differs from this initial t<strong>on</strong>nage band the registrant<br />

will have to update his registrati<strong>on</strong> dossier as described in secti<strong>on</strong> 7.4 of this document.<br />

Legal entities are advised to check whether they submitted a notificati<strong>on</strong> for their substance to<br />

a Member State competent authority in accordance with the nati<strong>on</strong>al legislati<strong>on</strong> implementing<br />

Directive 67/548/EEC. If this is the case, they have an official notificati<strong>on</strong> number <strong>on</strong> file which<br />

was allocated by the Member State competent authority. The substance will in that case also<br />

appear <strong>on</strong> the European List of Notified Chemical Substances (ELINCS).<br />

Notificati<strong>on</strong> under Directive 67/548/EEC was <strong>on</strong>ly required if a substance was placed <strong>on</strong> the EU<br />

market or imported into the EU. If a substance was merely manufactured in the EU, but not<br />

placed <strong>on</strong> the market, a notificati<strong>on</strong> would not have been made. These substances will have to<br />

be registered under REACH.<br />

Manufacturers or importers of polymers which were notified according to Directive 67/548/EEC<br />

are advised to read the <str<strong>on</strong>g>Guidance</str<strong>on</strong>g> for polymers where the specific steps to claim a registrati<strong>on</strong><br />

number for a notified polymer are explained in detail.<br />

It is important to remark that a notificati<strong>on</strong> under Directive 67/548/EEC is nominal<br />

so that <strong>on</strong>ly the notifier benefits from being c<strong>on</strong>sidered registered; any other parties<br />

manufacturing or importing the substance but who have not notified it, must<br />

register, unless there is another exempti<strong>on</strong> that applies to them.<br />

2.2.5 Obligati<strong>on</strong>s related to registrati<strong>on</strong> of intermediates<br />

REACH establishes specific obligati<strong>on</strong>s for intermediates as previously explained in secti<strong>on</strong><br />

2.2.5. While n<strong>on</strong>-isolated intermediates are not covered by REACH, isolated intermediates<br />

have reduced requirements depending <strong>on</strong> the c<strong>on</strong>diti<strong>on</strong>s of manufacture and use.<br />

The following types of isolated intermediates are defined under REACH:<br />

Transported isolated intermediates<br />

An <strong>on</strong>-site isolated intermediate is an intermediate not meeting the criteria of a n<strong>on</strong>isolated<br />

intermediate and where the manufacture of the intermediate and the synthesis of<br />

(an)other substance(s) from that intermediate take place <strong>on</strong> the same site, operated by <strong>on</strong>e or<br />

more legal entities (Article 3(15)(b)).<br />
