8 Appeal procedures<br />

Where a registrant or potential registrant disagrees with certain decisi<strong>on</strong>s issued by <strong>ECHA</strong>, he<br />

can appeal against the decisi<strong>on</strong> to <strong>ECHA</strong>’s Board of Appeal.<br />

An appeal may be brought against <strong>ECHA</strong>’s decisi<strong>on</strong>s in the following cases:<br />

1) PPORD exempti<strong>on</strong>s<br />

a. - decisi<strong>on</strong> of <strong>ECHA</strong> to impose additi<strong>on</strong>al c<strong>on</strong>diti<strong>on</strong>s <strong>on</strong> the exempti<strong>on</strong> to ensure<br />

that the substance is handled and disposed of in a c<strong>on</strong>trolled way and is not<br />

made available to the public (Article 9(4));<br />

b. - decisi<strong>on</strong> of <strong>ECHA</strong> <strong>on</strong> the extensi<strong>on</strong> of the exempti<strong>on</strong> period (Article 9(7)).<br />

2) Completeness check - decisi<strong>on</strong> of <strong>ECHA</strong> to reject a registrati<strong>on</strong> if the registrant failed<br />

to complete his registrati<strong>on</strong> within the deadline set by <strong>ECHA</strong> (Article 20(2)) (see<br />

secti<strong>on</strong> 10.4).<br />

3) Data sharing<br />

a. - decisi<strong>on</strong> of <strong>ECHA</strong> to give permissi<strong>on</strong> to a potential registrant of a n<strong>on</strong> phase-in<br />

substance to refer to the informati<strong>on</strong> submitted by a previous registrant in his<br />

registrati<strong>on</strong> dossier (Article 27(6));<br />

b. - decisi<strong>on</strong> of <strong>ECHA</strong> <strong>on</strong> data sharing for phase-in substances (Article 30 (3)).<br />

4) Evaluati<strong>on</strong> - decisi<strong>on</strong> of <strong>ECHA</strong> requesting the submissi<strong>on</strong> of additi<strong>on</strong>al informati<strong>on</strong><br />

under the evaluati<strong>on</strong> procedures (Articles 51 (3), 51(6) and 52(2)).<br />

An appeal has suspensive effect. All appeals must c<strong>on</strong>tain a statement of the grounds <strong>on</strong> which<br />

the appeal is based.<br />

Any natural or legal pers<strong>on</strong> may appeal against a decisi<strong>on</strong> addressed to that pers<strong>on</strong>, or against<br />

a decisi<strong>on</strong> which although addressed to another pers<strong>on</strong> is of direct and individual c<strong>on</strong>cern to<br />

the pers<strong>on</strong> making the appeal.<br />

The appeal must be filed in writing to <strong>ECHA</strong> within three m<strong>on</strong>ths of the notificati<strong>on</strong> of the<br />

decisi<strong>on</strong> to the pers<strong>on</strong> c<strong>on</strong>cerned, or in the absence of notificati<strong>on</strong>, within three m<strong>on</strong>ths of the<br />

day <strong>on</strong> which the decisi<strong>on</strong> became known to him. For fees <strong>on</strong> the appeal, please c<strong>on</strong>sult<br />

Commissi<strong>on</strong> Regulati<strong>on</strong> (EC) No 340/2008 of 16 April 2008 <strong>on</strong> the fees and charges payable to<br />

the European Chemicals Agency.<br />

If, after c<strong>on</strong>sultati<strong>on</strong> with the Chairman of the Board of Appeal, the Executive Director of <strong>ECHA</strong><br />

c<strong>on</strong>siders the appeal to be admissible and well founded he may rectify the decisi<strong>on</strong> within 30<br />

days of the appeal being filed. Otherwise the Chairman of the Board of Appeal examines if the<br />

appeal is admissible within 30 days of the appeal being filed. If yes, he remits the appeal to<br />

the Board of Appeal for examinati<strong>on</strong> of the grounds. The Board of Appeal may exercise any<br />

power which lies within the competence of <strong>ECHA</strong> or remit the case to the competent body of<br />

<strong>ECHA</strong> for further acti<strong>on</strong>.<br />

If the party c<strong>on</strong>cerned still disagrees with the result, an acti<strong>on</strong> may be brought before the<br />

General Court or the Court of Justice c<strong>on</strong>testing the decisi<strong>on</strong> taken by the Board of Appeal.<br />

Similarly, where no right of appeal lies before the Board, acti<strong>on</strong> against an <strong>ECHA</strong> decisi<strong>on</strong> may<br />

be brought before the General Court or the Court of justice.<br />
