A co-formulant in the c<strong>on</strong>text of plant protecti<strong>on</strong> products is a n<strong>on</strong>-active substance in a<br />

plant protecti<strong>on</strong> product which is a mixture.<br />

(2) The substance is included in <strong>on</strong>e of the following:<br />

Annex I to Directive 91/414 – this is the list of active substances which may be used in<br />

plant protecti<strong>on</strong> products; it is regularly updated and manufacturers and importers are<br />

advised to check the latest versi<strong>on</strong>.<br />

Regulati<strong>on</strong> (EEC) No 3600/92 – this regulati<strong>on</strong> lists 90 active substances which were<br />

already <strong>on</strong> the market <strong>on</strong> 26 July 1993 and which were the first <strong>on</strong>es to be identified for<br />

assessment with a view to being authorised and included into Annex I to Directive<br />

91/414/EEC.<br />

Regulati<strong>on</strong> (EC) No 703/2001 – this regulati<strong>on</strong> lists a further 63 active substances<br />

which were already <strong>on</strong> the market <strong>on</strong> 26 July 1993 and for which their producers<br />

wished to secure inclusi<strong>on</strong> into Annex I of Directive 91/414/EEC and which were thus<br />

identified for assessment.<br />

Regulati<strong>on</strong> (EC) No 1490/2002 - this regulati<strong>on</strong> lists a further 161 active substances<br />

which were already <strong>on</strong> the market <strong>on</strong> 26 July 1993 and for which their producers<br />

wished to secure inclusi<strong>on</strong> into Annex I of Directive 91/414/EEC and which were thus<br />

identified for assessment.<br />

Decisi<strong>on</strong> 2003/565/EC – this decisi<strong>on</strong> lists further active substances already <strong>on</strong> the<br />

market <strong>on</strong> 26 July 1993 for which the assessment period was extended.<br />

a Commissi<strong>on</strong> decisi<strong>on</strong> <strong>on</strong> the completeness of the dossier submitted pursuant to Article<br />

6 (3) of Directive 91/414/EEC – such decisi<strong>on</strong>s are taken in respect of active substances<br />

which were not yet <strong>on</strong> the market <strong>on</strong> 26 July 1993 but for which an applicati<strong>on</strong> for<br />

inclusi<strong>on</strong> into Annex I of Directive 91/414/EEC was submitted and deemed admissible.<br />

They c<strong>on</strong>cern the admissibility of applicati<strong>on</strong>s filed by individual legal entities and are<br />

therefore not published in the Official Journal, but notified to the legal entities<br />

c<strong>on</strong>cerned. Accordingly, relevant operators will be aware of decisi<strong>on</strong>s of interest to<br />

them.<br />

Note that quantities of the same active substance used for other uses than in plant protecti<strong>on</strong><br />

products are not regarded as being registered even if they are included in <strong>on</strong>e of the abovementi<strong>on</strong>ed<br />

categories.<br />

It is important to remark that since c<strong>on</strong>diti<strong>on</strong> (2) above can <strong>on</strong>ly be met by active substances,<br />

in practice <strong>on</strong>ly active substances can be regarded as registered. Other substances<br />

(including co-formulants) used for producing the plant protecti<strong>on</strong> product need to be<br />

registered.<br />

Registrati<strong>on</strong> is not necessary even after a decisi<strong>on</strong> not to include the active substance in Annex<br />

I to Directive 91/414.<br />

Example<br />

A manufacturer manufactured 100 t<strong>on</strong>nes of copper sulphate in year X. 50 t<strong>on</strong>nes are used<br />

as active substances in pesticides and the active substance is included in <strong>on</strong>e of the acts<br />

menti<strong>on</strong>ed under (2) above, the other 50 t<strong>on</strong>nes are used for other purposes. This latter use<br />

is in n<strong>on</strong>-plant protecti<strong>on</strong> products and has to be registered; the former use is in plant<br />

protecti<strong>on</strong> products and is regarded as registered.<br />

2.2.4.3 Notified substances according to Directive 67/548/EEC<br />

Directive 67/548/EEC introduced a notificati<strong>on</strong> requirement for so-called new substances,<br />
