10. The following substances if they are not chemically modified:<br />
Liquefied petroleum gas, natural gas c<strong>on</strong>densate, process gases and comp<strong>on</strong>ents thereof,<br />
coke, cement clinker, magnesia.<br />
11. The following substances unless they meet the criteria for classificati<strong>on</strong> as dangerous<br />
according to Directive 67/548/EEC and provided that they do not c<strong>on</strong>tain c<strong>on</strong>stituents<br />
meeting the criteria as dangerous in accordance with Directive 67/548/EEC present in<br />
c<strong>on</strong>centrati<strong>on</strong>s above the lowest of the applicable c<strong>on</strong>centrati<strong>on</strong> limits set out in Directive<br />
1999/45/EC or c<strong>on</strong>centrati<strong>on</strong> limits set out in Annex I to Directive 67/548/EEC, unless<br />
c<strong>on</strong>clusive scientific experimental data show that these c<strong>on</strong>stituents are not available<br />
throughout the lifecycle of the substance and those data have been ascertained to be<br />
adequate and reliable:<br />
Glass, ceramic frits.<br />
12. Compost and biogas.<br />
13. Hydrogen and oxygen.<br />

2.2.3.5 Recovered substance already registered<br />
The REACH Regulati<strong>on</strong> exempts from registrati<strong>on</strong> substances which are recovered in the EU,<br />
provided a number of c<strong>on</strong>diti<strong>on</strong>s are met. Recycling is a form of recovery and therefore<br />
covered by this exempti<strong>on</strong>.<br />
‘Recovery’ is currently defined in EU law as any of the recovery operati<strong>on</strong>s provided in Annex II<br />
of the Waste Framework Directive 2008/98/EC. This n<strong>on</strong>-exhaustive list covers the following<br />
operati<strong>on</strong>s:<br />

Use principally as a fuel or other means to generate energy<br />

Recycling/reclamati<strong>on</strong> of organic substances which are not used as solvents (including<br />
composting and other biological transformati<strong>on</strong> processes)<br />
Recycling/reclamati<strong>on</strong> of metals and metal compounds<br />
Recycling/reclamati<strong>on</strong> of other inorganic materials<br />
Regenerati<strong>on</strong> of acids or bases<br />
Recovery of comp<strong>on</strong>ents used for polluti<strong>on</strong> abatement<br />
Recovery of comp<strong>on</strong>ents from catalysts<br />
Oil re-refining or other reuses of oil<br />
Land treatment resulting in benefit to agriculture or ecological improvement<br />
Use of waste obtained from any of the operati<strong>on</strong>s numbered R1 to R10<br />
Exchange of waste for submissi<strong>on</strong> to any of the operati<strong>on</strong>s numbered R1 to R11<br />
Storage of waste pending any of the operati<strong>on</strong>s numbered R1 to R12 (excluding<br />
temporary storage, pending collecti<strong>on</strong>, <strong>on</strong> the site where it is produced).<br />
