It is important to note that the ‘n<strong>on</strong>-EU manufacturer’ or supplier who is exporting a substance<br />
or mixture into the EU has no resp<strong>on</strong>sibilities under REACH. The shipping company that is<br />
transporting the substance or mixture normally has no obligati<strong>on</strong>s under REACH either.<br />
Excepti<strong>on</strong>s may occur under specific c<strong>on</strong>tractual arrangements if the shipping company is<br />
established in the EU and if it is resp<strong>on</strong>sible for the introducti<strong>on</strong> of the substance into the EU.<br />
In additi<strong>on</strong>, it should be noted that when interpreting the term ‘importer’ according to the<br />
REACH Regulati<strong>on</strong>, it is not possible to fall back up<strong>on</strong> the Community Customs Code<br />
(Regulati<strong>on</strong> (EEC) No 2913/92) or the ‘INCOTERMS’.<br />
In case an ‘<strong>on</strong>ly representative’ has been appointed the <strong>on</strong>ly representative is resp<strong>on</strong>sible for<br />
the registrati<strong>on</strong> (see next secti<strong>on</strong>).<br />
2.1.2.5 Only representative of a ‘n<strong>on</strong>-EU manufacturer’<br />
Substances imported into the EU <strong>on</strong> their own, in mixtures or, under certain c<strong>on</strong>diti<strong>on</strong>s, in<br />
articles need to be registered by their EU importers. This implies that each individual importer<br />
needs to register the substance(s) he imports. However, under REACH, a natural or legal<br />
pers<strong>on</strong> established outside the EU, who manufactures a substance, formulates a<br />
mixture or produces an article can appoint an <strong>on</strong>ly representative to carry out the<br />
required registrati<strong>on</strong> of the substance that is imported (as such, in a mixture or in an article)<br />
into the EU (Article 8(1)). This will relieve the EU importers within the same supply chain from<br />
their registrati<strong>on</strong> obligati<strong>on</strong>s, as they will be regarded as downstream users.<br />
