9 Fees<br />

Title IX of the REACH Regulati<strong>on</strong> describes the general principles regarding the payment of<br />

fees and charges in relati<strong>on</strong> to REACH. More specifically, the Fee Regulati<strong>on</strong> (Commissi<strong>on</strong><br />

Regulati<strong>on</strong> (EC) No 340/2008 of 16 April 2008) stipulates the payment terms for <strong>ECHA</strong>’s<br />

invoices. The amount and deadlines for payment depend <strong>on</strong> the type of submissi<strong>on</strong> under<br />

c<strong>on</strong>siderati<strong>on</strong>.<br />

9.1 Applicable fees and calculati<strong>on</strong> of fees<br />

A registrant is obliged to pay a fee for his registrati<strong>on</strong> as a c<strong>on</strong>tributi<strong>on</strong> to covering the costs<br />

imposed <strong>on</strong> <strong>ECHA</strong> and the Member States Competent Authorities. In order for <strong>ECHA</strong> to be able<br />

to establish an invoice, the registrant is asked to submit his billing informati<strong>on</strong> <strong>on</strong>-line either<br />

before the first registrati<strong>on</strong> is made or during the first registrati<strong>on</strong> process.<br />

The system to be applied for the computati<strong>on</strong> of the applicable fee shall be the following:<br />

Once the registrant has submitted a registrati<strong>on</strong> dossier and it has been accepted for<br />

processing (see secti<strong>on</strong> 10.1), the REACH-IT system automatically computes the applicable fee<br />

for the dossier submitted.<br />

When calculating the fee, the following points will be taken into c<strong>on</strong>siderati<strong>on</strong>:<br />

the scale of fees fixed for the different t<strong>on</strong>nage bands;<br />

an SME (small and medium-sized enterprise) reducti<strong>on</strong> if applicable, for this purpose<br />

the registrant will be asked to make a declarati<strong>on</strong> of his status in REACH-IT;<br />

a reducti<strong>on</strong> for joint submissi<strong>on</strong>, if applicable;<br />

the items flagged as c<strong>on</strong>fidential (see secti<strong>on</strong> 3.4 <strong>on</strong> access to informati<strong>on</strong> and<br />

c<strong>on</strong>fidential data).<br />

Where a registrati<strong>on</strong> is submitted by an <strong>on</strong>ly representative, the size of the ‘n<strong>on</strong>-EU<br />

manufacturer’ is decisive for the fee and must be entered into the relevant field in REACH-IT,<br />

not the size of the <strong>on</strong>ly representative.<br />

As so<strong>on</strong> as possible after the registrati<strong>on</strong> dossier has been accepted for processing, normally in<br />

the course of the next working day, <strong>ECHA</strong> will issue an invoice for the registrati<strong>on</strong> dossier(s)<br />

submitted. Up<strong>on</strong> receipt of the invoice, the registrant needs to carry out the payment as<br />

indicated in the invoice.<br />

<strong>ECHA</strong> checks whether companies that claimed to be SMEs and thus paid reduced fees for their<br />

registrati<strong>on</strong>s are indeed SMEs. Where such a verificati<strong>on</strong> results in a finding that the registrant<br />

was not a SME and hence not entitled to the fee reducti<strong>on</strong>, he will be liable to pay the<br />

difference between the reduced fee and the full registrati<strong>on</strong> fee as well as an administrative<br />

charge.<br />

The criteria to be applied for the definiti<strong>on</strong> of an SME are established in Commissi<strong>on</strong><br />

Recommendati<strong>on</strong> 2003/361/EC. The reader is advised to c<strong>on</strong>sult the <strong>ECHA</strong> website<br />

(http://echa.europa.eu/web/guest/support/small-and-medium-sized-enterprises-smes) if in<br />

need of more specific informati<strong>on</strong> <strong>on</strong> the SME status.<br />

9.2 Fee for updating of a registrati<strong>on</strong> dossier<br />

An update shall be accompanied by the relevant part of the fee. As with a first time<br />
