The mllole legality of the election of trustees was questioned, and the
supercession of Mr. Agnrcl by the appointee of the new board was
tested in a case presented before Juclge McC~~llough, in September,
1880, at Toulon. Messrs. Fuller and Shallenberger appearetl for A. G.
Hammoncl; DiIessrs. Decker and Wilson, for C. F. Hamilton, who had
also been appointed treasurer by a minority of the bo;~,i~d of trustees.
This was decided in favor of the clefenclant', ancl Mr. I-Ialnmontl retained
the office. I\Iessrs. Miller, Jorclan and James R. Gallrin formed
