Roads Act 1993 Under Section 138 of the Roads Act 1993, a person must not “erect a structure or carry out a work in, on or over a public road, or dig up or disturb the surface of a public road...” other than with the consent of the appropriate roads authority. Cremona Road will be used to access the proposed site and is not a classified road under the meaning of the Roads Act. Further, no structures or works will be erected or undertaken on Cremona Road. Approval from the Roads and Traffic Authority will not be required. Threatened Species Conservation Act 1995 The Threatened Species Conservation Act 1995 (TSC Act) is directed at conserving threatened species, populations and ecological communities of animals and plants. Threatened species, populations, endangered ecological communities are not likely to occur at the site and further consideration under the act is not required. 2.6 Commonwealth legislation Environment Protection and Biodiversity Conservation Act 1999 The primary legislation at the Commonwealth level is the Environment Protection and Biodiversity Conservation Act 1999 (EPBC Act). Part 3 of the EPBC Act requires approval from the Commonwealth Minister for Sustainability, Environment, Water, Population and Communities if a development is likely to have, or would have, a significant effect on a matter of National Environmental Significance (NES). For the purposes of the EPBC Act, matters of NES are defined as: • world heritage properties; • national heritage places; • Ramsar wetlands; • nationally threatened species and ecological communities; • migratory species; • commonwealth marine areas; and • nuclear actions. The proposed work will not affect any matters of national environmental significance. Commonwealth land will not be affected, either directly or indirectly, as a result of this proposal. A summary of EPBC factors is included in Table 4.
Referral to the Commonwealth Minister for Sustainability, Environment, Water, Population and Communities for further consideration or approval in relation to potential flora and fauna impacts associated with the proposal is not considered necessary. Civil Aviation (Building Control) Regulation 1988 The regulation controls site and height of buildings that may affect flights. Buildings must not penetrate any obstacle limitation surface shown on any relevant Obstacle Surface Plan that has been prepared by a potentially affected airport or aerodrome. If a building is within the obstacle limitations, an approval from Civil Aviation Safety Authority of Australia (CASAA) must be obtained. The proposed site is outside the restriction zones of Mascot Airport and provisions of the regulation do not apply. 2.7 Ecological Sustainable Development Ecologically sustainable development (ESD) entails using, conserving and enhancing the community’s environmental resources in a manner that sustains and improves ecological processes and, hence, the quality of life, for present and future generations. The basis for achieving ecologically sustainable development involves the application of four principles: • the precautionary principle; • intra and inter-generational equity; • conservation of biological diversity and ecological integrity; and • improved valuation and pricing of environmental resources. RailCorp is committed to ensuring its projects are consistent with the principles of ESD and the principles of ESD have been considered for this proposal (refer Table 1). The site selected is within a previously disturbed area in the rail corridor. In addition, some of the potential impacts are reversible as the monopole and cabinets can be removed, if no longer required. Any adverse impacts associated with the site and construction will be minor and measures to reduce impacts identified within this REF will be implemented during construction, as far as practicable.
