make productive use of l<strong>and</strong> <strong>and</strong> thereby reduce the potential for evictions. F<strong>in</strong>ally, <strong>in</strong>terventions could<br />

bolster traditional social obligations around protect<strong>in</strong>g widows <strong>and</strong> ensur<strong>in</strong>g that women have the right to<br />

return to their natal communities.<br />

Cont<strong>in</strong>ue the moratorium on public l<strong>and</strong> sales.<br />

Institute more str<strong>in</strong>gent enforcement of the moratorium <strong>and</strong> close loopholes that have allowed some<br />

<strong>in</strong>dividuals to by-pass it.<br />

Instate a moratorium on the grant<strong>in</strong>g of concessions on case-by-case basis until measures are <strong>in</strong> place<br />

to protect communities‟ l<strong>and</strong> rights. The moratorium need not be placed over the whole country<br />

before any <strong>in</strong>vestment/concessions can take place, but rather could be prioritized on a case-by-case<br />

basis <strong>in</strong> each specific area where <strong>in</strong>vestments/concessions are planned. The measures that could be<br />

put <strong>in</strong> place <strong>in</strong>clude:<br />

o A law that grants legal recognition to l<strong>and</strong> claimed under customary tenure;<br />

o Regulations that map out a process for systematically document<strong>in</strong>g the l<strong>and</strong> rights of rural<br />

communities based on custom; <strong>and</strong><br />

o The enactment <strong>and</strong> completion of that process at national level.<br />

Consider a new Public <strong>L<strong>and</strong></strong> Law that “def<strong>in</strong>es public l<strong>and</strong> <strong>and</strong> clearly dist<strong>in</strong>guishes between public<br />

l<strong>and</strong> <strong>and</strong> l<strong>and</strong> held by local communities under customary l<strong>and</strong> tenure” (Bruce <strong>and</strong> Kanneh, 2010).<br />

Consider a Community Rights Law that provides explicit recognition of customary l<strong>and</strong> rights as<br />

perpetual, heritable rights subject to the same legal protections as rights granted <strong>in</strong> fee simple.<br />

Under Community Rights Law, def<strong>in</strong>e „Community <strong>L<strong>and</strong></strong>‟ as “l<strong>and</strong> available for communities to exert<br />

perpetual, heritable rights to l<strong>and</strong> via customary law, which is <strong>in</strong>alienable unless removed by a<br />

member of the claimant community via a prescribed process to convert it to fee simple tenure.”<br />

Consider apply<strong>in</strong>g Community <strong>L<strong>and</strong></strong> to all l<strong>and</strong> fall<strong>in</strong>g outside designated urban zones that are currently<br />

unencumbered by legitimately acquired fee simple deeds, government claims, or exist<strong>in</strong>g leaseholds or<br />

concessions.<br />

The pr<strong>in</strong>cipal basis for documentation of customary tenure should be the unit with<strong>in</strong> which primary<br />

rights to access l<strong>and</strong> <strong>and</strong> natural resources are acquired <strong>and</strong> where the ma<strong>in</strong> locus of l<strong>and</strong> <strong>and</strong> resource<br />

governance is housed – the ”core tenure unit.” The documents should be those of localities, not<br />

<strong>in</strong>dividuals.<br />

Consider simpler approaches for record<strong>in</strong>g the l<strong>and</strong> rights of core tenure units based on low-cost<br />

demarcation methods along with a certificate that describes the rights granted to the community <strong>and</strong> a<br />

basic description of the physical boundaries <strong>and</strong> sketch map of the claimed area.<br />

If feasible, demarcation should <strong>in</strong>volve a process whereby rights can be recorded on a cadaster so that<br />

a graphic composite of community claims is available <strong>and</strong> can be used to <strong>in</strong>form the actions of<br />

government <strong>and</strong> potential claimants, as well as evidence <strong>in</strong> case of disputes.<br />

Certificate could also <strong>in</strong>clude “encumbrances,” such as secondary rights granted to neighbor<strong>in</strong>g<br />

communities to harvest certa<strong>in</strong> natural resources.<br />

Consider systematically record<strong>in</strong>g Community <strong>L<strong>and</strong></strong> rights throughout the country at m<strong>in</strong>imal or no cost<br />

to those communities apart from their time to participate <strong>in</strong> the process.<br />

In record<strong>in</strong>g Community <strong>L<strong>and</strong></strong> rights, privilege oral testimony <strong>and</strong> other customary forms of evidence<br />

as proof of customary claims.<br />

Comb<strong>in</strong>e or follow up with the development of local “conventions” or by-laws for l<strong>and</strong> <strong>and</strong> natural<br />
