resource management to re<strong>in</strong>force exist<strong>in</strong>g customary rules <strong>and</strong> build on those to improve l<strong>and</strong> use<br />

practices.<br />

Where Tribal Certificates (TCs) have come to def<strong>in</strong>e the socially legitimate basis by which whole<br />

communities have sought to protect their l<strong>and</strong> rights under custom, use areas under TCs to form the<br />

basis for systematic certification of community hold<strong>in</strong>gs.<br />

Where TCs have been used to exclude members of the community who historically had customary<br />

rights to access l<strong>and</strong> <strong>in</strong> that doma<strong>in</strong>, renegotiate claims to identify the most socially legitimate <strong>and</strong><br />

equitable option for vest<strong>in</strong>g rights <strong>and</strong> document those new claims.<br />

Engage NGOs <strong>and</strong> <strong>in</strong>dividuals with deep experience <strong>in</strong> mediat<strong>in</strong>g l<strong>and</strong> disputes to mediate<br />

negotiations around TCs.<br />

Clarify rights embodied by deeds for entire clans or districts, such that they uphold, or at least do not<br />

<strong>in</strong>terfere with, the rights granted to core tenure units.<br />

Transfer deeds issued <strong>in</strong> the name of <strong>in</strong>dividuals to the name of the broader community claim<strong>in</strong>g the<br />

rights. The names on the new deeds should be those of locality, not <strong>in</strong>dividuals.<br />

Institute a process whereby communities can challenge the validity of <strong>in</strong>authentic deeds <strong>and</strong>/or deeds<br />

acquired through irregular means.<br />

Introduce a probate mechanism that would require heirs of deed holders to transfer l<strong>and</strong> <strong>in</strong>to their<br />

names. If they fail to do so, the l<strong>and</strong> should revert to Community <strong>L<strong>and</strong></strong> <strong>and</strong> be available for one or more<br />

communities to claim based on evidence of their customary rights.<br />

Vest <strong>in</strong>alienable group rights <strong>in</strong> communities, but provide for the ability of <strong>in</strong>dividuals <strong>and</strong><br />

households to remove their claim from the broader community via a process sanctioned by the<br />

broader community, which would enable the person(s) to apply for fee simple tenure.<br />

Enable communities to govern l<strong>and</strong> held under group tenure accord<strong>in</strong>g to their customary rules.<br />

Support women‟s rights <strong>in</strong> their natal communities, such that their rights are equal to those of men.<br />

Support women‟s rights <strong>in</strong> their husb<strong>and</strong>‟s communities, such that their rights are equal to those of<br />

men <strong>in</strong> those communities.<br />

Provide for governance <strong>and</strong> adm<strong>in</strong>istration rights <strong>in</strong> the certification of communal l<strong>and</strong> hold<strong>in</strong>gs.<br />

Where appropriate, replace concessions with leaseholds issued by rural communities <strong>and</strong> facilitated by<br />

government.<br />

Support communities to negotiate fair leas<strong>in</strong>g terms with <strong>in</strong>vestors seek<strong>in</strong>g l<strong>and</strong> <strong>in</strong> exchange for<br />

government receiv<strong>in</strong>g a fixed share of rents.<br />

Institute community awareness programs to educate communities about possible benefits <strong>and</strong> pitfalls<br />

of leases.<br />

Encourage high st<strong>and</strong>ards of transparency <strong>and</strong> robust accountability systems to mitigate <strong>in</strong>centives for<br />

collusion <strong>and</strong> corruption undertaken by <strong>in</strong>vestors <strong>and</strong> government authorities at the expense of<br />

communities.<br />

Grant recognition to governance authorities at the level of the core tenure unit; vest the rights <strong>and</strong><br />

responsibilities to govern l<strong>and</strong> <strong>and</strong> natural resources with<strong>in</strong> that core tenure unit.<br />

Facilitate establish<strong>in</strong>g new authorities (e.g., councils) for l<strong>and</strong> <strong>and</strong> natural resources where<br />

communities deem this appropriate.<br />

Enable communities <strong>in</strong> collaboration with the government to determ<strong>in</strong>e the formats <strong>and</strong> by-laws for<br />

l<strong>and</strong> <strong>and</strong> natural resource governance.<br />

Promote the <strong>in</strong>tegration of women <strong>and</strong> youth as governance authorities over l<strong>and</strong>, such as through<br />

CUSTOMARY LAND TENURE IN LIBERIA
