Orders to conclude proceedings must include the grounds that<br />

justify them and the corresponding decisions with reference to<br />

any accusers involved.<br />

Article 144.<br />

Examining Official<br />

The <strong>Euroleague</strong> <strong>Basketball</strong> CEO will commence the proceedings<br />

by appointing the Examining Official that will be in charge of<br />

them.<br />

The Examining Official will draw up a case report on the<br />

evidence, deciding whether the alleged infringement is minor or<br />

serious, and the procedure to be followed.<br />

Article 145.<br />

Procedure for Minor Infringements<br />

145.1. If the Examining Official considers that the case constitutes a<br />

minor infringement, the party concerned will be informed of the<br />

opening of a disciplinary proceeding, the alleged infringement,<br />

the articles to be applied, and any sanction that may be<br />

imposed.<br />

145.2. The party concerned will be entitled, within a period of 24 hours<br />

from receipt of the notification, to make any appropriate<br />

arguments in defence, adjoining any pertinent evidence in<br />

support of them. After this period the Examining Official will not<br />

admit any further arguments in defence other than those<br />

specially requested by her, and the examining procedure will<br />

then be regarded as completed.<br />

145.3. When the corresponding arguments in defence have been made,<br />

or the time allowed for them has elapsed, the Examining Official<br />

will make a report on the case to the <strong>Euroleague</strong> <strong>Basketball</strong><br />

CEO, who will then make the decision that brings the disciplinary<br />

proceeding to a close. The decision will contain an account of the<br />

facts of the infringement, the corresponding articles and the<br />

sanction imposed. It must be sent in writing to the parties<br />

concerned, directly or through the club to which the person<br />

concerned belongs.<br />

145.4. Before making a decision, the <strong>Euroleague</strong> <strong>Basketball</strong> CEO may<br />

issue a resolution requiring and explaining further proceedings<br />

deemed essential for the purposes of reaching a decision; the<br />

parties concerned will be notified of this and granted 24 hours to<br />

present their arguments in defence.<br />
