The Company will promptly acknowledge receipt of the Request for<br />

Mediation and send a copy thereof to all parties concerned.<br />

4. As soon as possible, the Company will consult orally or in writing with<br />

all concerned parties and establish the date for a mediation meeting<br />

and a short time-limit for submission by each concerned party to the<br />

<strong>Euroleague</strong> <strong>Basketball</strong> office of a statement summarising the position<br />

on the dispute, including a description of all facts and points of law<br />

deemed relevant, and annexing any relevant document. The Company<br />

will promptly communicate copies thereof to all other parties.<br />

5. The <strong>Euroleague</strong> <strong>Basketball</strong> CEO may at any time appoint, revoke or<br />

replace a mediator of his choice, who shall be his delegate and shall<br />

assist him or substitute for him in performing any tasks under this<br />

Mediation Regulation.<br />

6. In cases when a letter of clearance has already been denied by a<br />

national federation, clubs in dispute are authorised to submit petitions<br />

or appeals to the relevant FIBA bodies for the purpose of avoiding the<br />

expiry of any deadline provided by FIBA Regulations. At the same<br />

time, the clubs in dispute must request the relevant FIBA bodies to<br />

suspend shortly the decision process due to the on-going settlement<br />

negotiations between the concerned parties.<br />

7. The <strong>Euroleague</strong> <strong>Basketball</strong> CEO or the appointed mediator, with a view<br />

to keeping friendly relations between European clubs:<br />

a) Will advance the mediation without any formality and as<br />

expeditiously and effectively as possible;<br />

b) Will facilitate discussion of the issues by the parties and promote<br />

the settlement of the dispute in any manner that he believes to<br />

be appropriate;<br />

c) May adopt any procedural resolutions, make any suggestions or<br />

propose any solutions he deems appropriate;<br />

d) May discretionally talk or meet with all parties jointly, or<br />

separately with one or some of the parties or with any third<br />

parties;<br />

e) May not impose a settlement or solution of the dispute.<br />
