3. The President or Dean of <strong>Student</strong>s shall notify members of the Judiciary Council or<br />
Discipline Review Committee within a 72-hour time period before said meeting is to<br />
convene.<br />
4. The student may have an advisor of his choice. Lawyers may be present if both parties<br />
have lawyers and the <strong>College</strong> has a lawyer present. Advisors may be a friend, faculty<br />
person, administrator, either from within or outside the campus. Advisors may speak<br />
only to the person they are advising.<br />
5. During the hearing, the student defendant shall be afforded all rights required by due<br />
process including:<br />
• The right to question the complainant.<br />
• The right to present evidence in his/her behalf.<br />
• The right to call witness(es) in his/her behalf.<br />
• The right to remain silent and have no inference of guilt drawn from such silence.<br />
• The right to cross examination.<br />
• The right to appeal the decision and to be so advised.<br />
• The right to have a written transcript made at his/her expense, if requested.<br />
6. The student defendant is also entitled to the right to attend all classes and required<br />
<strong>College</strong> functions until a hearing is held and a decision rendered. Exception is made<br />
when the student’s presence would create a clear and present danger of interference with<br />
the normal operation and processes or requirements of appropriate discipline at the<br />
<strong>College</strong>. In such case, the Office of the Dean of <strong>Student</strong>s may impose temporary<br />
protective measures, including suspension, pending a hearing, which may be reasonably<br />
necessary. Such temporary protective measures may be applied where the student is<br />
accused of the regulation. It should be understood that such temporary protective<br />
measures, if applied, will be without avoidable prejudice to the student.<br />
7. <strong>Student</strong>s shall not be subject to double jeopardy for any offense.<br />
8. Faculty members and administrators are subject to the same judicial procedures as<br />
students in the event they are either the plaintiff, defendant or witness in any cause of<br />
action.<br />
9. The Office of Finance and Administration and the Dean of <strong>Student</strong>s’ Office will reinforce<br />
decisions of the judicial bodies by:<br />
• disallowing school registration for anyone who still owes a fine and<br />
• making certain the parent or guardian of the student is informed of the debt<br />
created as a result of a fine.<br />
General Guidelines for Effective Operation<br />
1. The hearing should be an orderly proceeding. The tape should be started when the<br />
chairman calls the meeting to order. The chairman should identify the nature of the case<br />
