f. Lighting. Lighting, when provided, shall be shielded and of low wattageso as to illuminate only the outdoor dining area and so as to avoidproducing glare that has a negative impact on pedestrian traffic. Thedesign of the light fixtures shall be compatible with the architecturaltheme of the building and business.g. Storage of Furniture and Equipment. All outdoor furnishings relatedto an outdoor dining area shall be stored inside during non-businesshours of operation. Non-permanent landscape planters may remainoutside.h. Maintenance. Outdoor dining areas shall be kept in good state ofrepair and maintained in a clean, safe and sanitary condition. Anyitem of furniture or equipment that is broken, rusting, degraded, torn,or tattered shall be removed promptly. The outdoor dining area mustbe swept and mopped every night after closing.i. Music and Live Entertainment. Music and Live Entertainment arepermitted as an accessory amentity. No dancing, cover charge orminimum drink will be permitted. Any music or entertainment willcomply with applicable noise ordinances and standards.j. Alcoholic Beverage Service. Alcoholic beverage service in outdoorseating areas shall conform to LVMC Title 6.37LAS VEGAS DOWNTOWNCENTENNIAL PLANOUTDOORDINING STANDARDS3. Encroachment Approval.Any dining or entertainment to take place within the public right-of-waywill require approval of an encroachment permit or agreement pursuant toLVMC 13.32.065.B. OUTDOOR DINING AND ENTERTAINMENTSTANDARDS: PRIVATE PROPERTY.1. Applicability.The standards of this subsection apply to outdoor dining or outdoorseating areas that occur or are proposed to occur on private property. For thepurposes of this subsection, the terms “outdoor dining or outdoor seating”and “outdoor dining or seating area” refer to an unenclosed dining or seatingarea on private property.2. 38friendly environment and adds to the vitality and livability of the downtownarea.3. Standards.LAS VEGAS DOWNTOWNCENTENNIAL PLANOUTDOORDINING STANDARDSWhen otherwise permitted within the underlying zoning district, outdoordining or outdoor seating on private property is permitted to take place in accordancewith the following standards:a. Location. Outdoor dining may occur only as an accessory use to aRestaurant establishment, and shall only be permitted on private property,except as otherwise allowed under this section. Outdoor seatingareas may be a permitted accessory to Urban Lounges in 18b The LasVegas Arts District, or accessory to Tavern-Limited establishments inthe East Village District. The outdoor dining or seating areas shall notextend onto adjacent properties or rights-of-way. The outdoor diningor seating areas shall not be located in a manner that interferes withbuilding egress and ingress as required by the International BuildingCode (IBC).b. Barriers. Outdoor dining and outdoor seating areas on private propertyshall have a permanent or temporary railing or other similarbarrier to define the area and to prevent encroachment onto adjacentproperties or rights of way.c. Furniture. All furnishings within an outdoor dining or seating areashall be made of sturdy, durable and commercial grade material, andshall complement the design theme of the business. Ordinary plasticlawn chairs and tables and similar furniture is not acceptable.d. Lighting.
