Naime, iakoenergetski subjekti nastoje, dugoroËno gledajuÊi,odræavati istu razinu investicija na godiπnjoj razini,njihovi troπkovi su razliËiti od godine do godine,a time i razina dozvoljenog prihoda. Pitanje je nakoji naËin Êe se HERA postaviti prema ovakvomproblemu s kojim se susreÊu regulatorna tijela.in the sense of achieving continuously regulatedprices. It is a question how the CERA willaddress this problem.4 ULOGA HRVATSKEENERGETSKE REGULATORNEAGENCIJE U DONO©ENJUPLANOVA RAZVOJA IIZGRADNJE4.1 Zakonodavno rjeπenjeHrvatski zakonodavac propisao je Zakonom o træiπtuelektriËne energije [8] da HEP OPS i HEP ODSdonose planove razvoja i izgradnje za razdoblje odtri godine uz prethodnu suglasnost HERA-e na prijedlogplanova. Meappleutim, zakonodavac ne prepoznajenadleænost HERA-e u davanju suglasnosti zaplanove razvoja i izgradnje djelatnosti proizvodnjei opskrbe elektriËnom energijom za tarifne kupce.PrimjenjujuÊi ovakvo zakonsko rjeπenje postavljase pitanje na koji naËin Êe HERA razmatrati investicijskeplanove subjekata za proizvodnju i opskrbuelektriËne energije i ukljuËiti opravdana ulaganjau regulatornu osnovicu sredstava, buduÊi dana njih temeljem Zakona [8] ne daje suglasnost, aprimjenjuje istu metodu regulacije kao kod monopolnihdjelatnosti ∑ metoda priznatog troπka. Onoπto je potrebno napomenuti je da su tarifni sustavi,koje je donijela HERA, a ne zakonodavac, uloguHERA-e u davanju suglasnosti na planove razvojai izgradnje definirali kao identiËnu za sve djelatnosti,iako to nije u skladu sa zakonskim odredbama.Nadalje, u tekstu svih tarifnih sustava navodi seda HERA daje suglasnost i na planove poslovanjasvih djelatnosti iako pojam plan poslovanja Zakon[8] isto tako ne prepoznaje.Takva razlika nadleænosti izmeappleu zakonskih odredabakoje je utvrdio Hrvatski sabor i odredaba kojeproizlaze iz podzakonskih akata koje je donijelosamo tijelo za sebe, u ovom sluËaju HERA, potenciraËinjenicu da se prije donoπenja drugog setaenergetskih zakona nije detaljno analizirala uloga ipozicija HERA-e kao regulatornog tijela u energetskomsektoru RH kao niti regulacija energetskihdjelatnosti kao disciplina sa svojim znaËajkama.4 THE ROLE OF THE CROATIANENERGY REGULATORYAGENCY IN THE ADOPTIONOF DEVELOPMENT ANDCONSTRUCTION PLANS4.1 Legislative solutionCroatian legislation stipulates that pursuant to theElectricity Market Act [8], the transmission systemoperator and the distribution system operator shalladopt development and construction plans for periodsof three years, pending prior approval of theproposed plans by the CERA. However, the legislationdoes not recognize the authority of the CERAin issuing approval for the development and constructionplans for the activities of the productionand supply of electrical energy for tariff customers.Applying such a legal solution, the question arisesconcerning how the CERA will analyze the investmentplans of the entities for the generation andsupply of electrical energy and include the justifiedinvestment in the regulatory asset base, since accordingto the Law [8] it does not issue approvaland applies the same method of regulation as formonopoly activities ∑ the regulation of the rate ofreturn. It should be mentioned that in the tariffsystems which the CERA has adopted, and not thelegislator, the roles of the CERA in issuing approvalfor development and construction plans are definedas identical for all activities, although this is notpursuant to the legal provisions.
