4.2.2 Iskustva Hrvatske energetske regulatorneagencijeHERA za sada nije pristupila izradi sliËnih kriterijaili stajaliπta o planovima razvoja i izgradnjeHEP OPS-a i HEP ODS-a, niti je utvrdila svoj stavprema dubini analize (prema javno dostupnim informacijama).Nepostojanje unaprijed definiranihkriterija za davanje suglasnosti na planove moglobi dodatno odgoditi donoπenje iznosa tarifnih stavkiza pojedine djelatnosti, buduÊi da je davanjesuglasnosti na planove preduvjet je za davanjemiπljenja na prijedlog iznosa tarifnih stavki kojeenergetski subjekt dostavlja Ministarstvu gospodarstva,rada i poduzetniπtva (MINGORP), a MIN-GORP prosljeappleuje HERA-i na miπljenje.4.3 Stavovi Hrvatske energetske regulatorne agencijeu rjeπavanju preduvjeta za primjenu metodepriznatih troπkovaIz prethodno iznesene rasprave vezano uz regulatornipristup gradnje blokova i regulatorni pristupukupnih troπkova vidljivo je da je vrlo znaËajnauloga regulatornoga tijela u utvrappleivanju opravdanerazine pojedinih regulatornih parametara. Utvrappleenametoda priznatih troπkova u donesenim tarifnimsustavima prepoznaje regulatorne parametre koji suranije analizirani kao πto su to ∑ regulatorna osnovicasredstava, amortizacija i stopa povrata u viduponderiranog prosjeËnog troπka kapitala. Tarifni sustavidefiniraju da miπljenje o priznatim troπkovimaposlovanja (OPEX) i stopi povrata kapitala dajeHERA, dok se kapitalni troπkovi (CAPEX) ∑ reguliranaosnovica sredstava, tj. prinos od reguliraneimovine i amortizacija utvrappleuju na osnovi planovarazvoja i izgradnje na koje HERA daje suglasnost.Utvrappleena metoda regulacije ne poznaje faktor uËinkovitostikao regulatorni parametar metode.Osim stava o dubini uplitanja u elemente planovaposlovanja, razvoja i izgradnje, HERA bi trebalapo miπljenju autora prilikom postupka davanjamiπljenja na prijedlog iznosa tarifnih stavki podjelatnostima, izmeappleu ostalog, svoj stav zauzeti io sljedeÊem:∑∑∑∑∑je li obavljen razvidan i dosljedan nadzor nadrazdvajanjem djelatnosti kako u tehniËkom itako i financijskom pogledu,opravdanoj razini stope povrata za svaku pojedinudjelatnost,koje investicije ukljuËiti u regulatornu osnovicusredstava, πto ukljuËuje i tumaËenje pojedinihpojmova iz tarifnih sustava, kao πto jenpr. pojam nove investicije koje su sufinancirane,a ukljuËene su u regulatornu osnovicusredstava,opravdanoj razini troπkova poslovanja (OPEX),i sliËno.The CERC also adopted a conclusion of a similarcharacter in the evaluation of the Development andConstruction Plan for the Distribution Network forthe Period from 2003 to 2005. At the same CERCsession, at which the CERC adopted the previouslymentioned conclusions, it also adopted the Decisionon Fees for Using the Transmission and DistributionNetworks [16], pursuant to the Electricity Market Actof 2001 [14]. This Decision is still in force, since thetariff systems that the CERA adopted are still in force.Figure 4 shows the course of the adoption of the relevantregulations and decisions that refer to the roleof the Croatian Energy Regulatory Agency ∑ CERA orthe Croatian Energy Regulatory Council ∑ CERC, inthe adoption of development and construction plansfor the transmission and distribution networks.4.2.2 Experience of the Croatian Energy RegulatoryAgencyFor the present, the CERA has not started to developsimilar criteria or positions on the developmentand construction plans of the transmission systemoperator and the distribution system operator, andhas not defined its position toward in-depth analysis.The lack of previously defined criteria for issuingapproval for plans could additionally postponethe adoption of the amounts of the tariff items forindividual activities, since the issuing of approvalfor the plans is a prerequisite for issuing an opinionon the proposed amounts of the tariff items whichan energy entity submits to the Ministry of theEconomy, Labor and Entrepreneurship, and whichthe Ministry forwards to the CERA for an opinion.4.3 Positions of the Croatian Energy RegulatoryAgency in resolving the prerequisites for the applicationof the rate of return (RoR) methodFrom the previous discussion of the building blockregulatory approach and the total expenditure regulatoryapproach, it is evident that the regulatorybody has a highly significant role in the determinationof the justified levels of individual regulatoryparameters. The rate of return method in theadopted tariff systems recognizes the regulatory parametersthat were analyzed previously, such as theregulatory asset base (RAB), depreciation and therate of return regarding the weighted average costof capital (WACC). The tariff systems stipulate thatan opinion on the recognized operating expenditure(OPEX) and the rate of return on capital shall beissued by the CERA, while the capital expenditure(CAPEX) ∑ the regulatory asset base, i.e. the revenuefrom regulated assets and depreciation shallbe determined on the basis of the development andconstruction plans which shall be approved by theCERA.
