4.2.1 Iskustva VijeÊa za regulaciju energetskihdjelatnostiZakon o træiπtu elektriËne energije iz 2001. godinetakoappleer je definirao da tadaπnje regulatorno tijelo,VijeÊe za regulaciju energetskih djelatnosti (VRED)[14], daje prethodnu suglasnost na plan razvojai izgradnje prijenosne i distribucijske mreæe. Hrvatskinezavisni operator sustava i træiπta d.o.o.(HNOSIT d.o.o.) i HEP Prijenos d.o.o. u 2003.godini proslijedili su Plan razvoja i izgradnje prijenosnemreæe za razdoblje od 2003. do 2005.godine, odnosno HEP Distribucija d.o.o. Plan razvojai izgradnje distribucijske mreæe za razdobljeod 2003. do 2005. godine, VRED-u radi davanjaprethodne suglasnosti. BuduÊi da prije toga VREDnije zauzeo stav prema naËinu na koji Êe pristupitidavanju prethodne suglasnosti na planove,VRED je pokrenuo izradu Kriterija i metodologijaplaniranja razvoja i izgradnje te zamjena i rekonstrukcijaprijenosne i distribucijske mreæe kojimase nastojalo na razvidan, jasan i dosljedan naËinutvrditi polazno stajaliπte regulatornog tijela visá-visstrategije razvoja prijenosne i distribucijskemreæe kao i kriterija za rekonstrukciju postojeÊihobjekata. ImajuÊi u vidu da rad regulatornog tijelatreba poËivati na naËelima razvidnosti, dosljednostii struËnosti, VRED je zauzeo stajaliπte da jeenergetskom subjektu potrebno jasno definirati πtose od njega oËekuje tako da i buduÊa stajaliπta,odnosno odluke regulatornog tijela budu na svojevrstannaËin predvidljive. Tim viπe ukoliko se radio kapitalno intenzivnim djelatnostima za Ëija ulaganjasu potrebne dugoroËnije analize kao i srednjoroËan,odnosno dugoroËan povrat investicijskihsredstava, koji se ujedno odraæava i u iznosu tarifnihstavki.Ilustrativni primjer VRED-ovog ZakljuËka iz 2003.godine koje je bilo ishodiπte za izradu Kriterija imetodologija planiranja razvoja i izgradnje te zamjenai rekonstrukcija prijenosne mreæe, odnosnopokretanje dorade dostavljenog Plana razvoja iizgradnje prijenosne mreæe za razdoblje od 2003.do 2005. godine, je sljedeÊi [15]:I. Plan je potrebno donijeti u skladu sa Strategijomenergetskog razvitka i Programomprovedbe Strategije energetskog razvitka,II. Da bi se provela procedura ocjene Plana idavanja suglasnosti na prijedlog Plana propisaneËlankom 12. stavak 1. Zakona o træiπtuelektriËne energije [14] potrebno je ispunitisljedeÊe uvjete:1) definirati kriterije i metodologiju planiranjarazvoja prijenosne mreæe kao i metodologijuplana zamjene i rekonstrukcije koje ÊeukljuËivati i ekonomske kriterije planiranja,4.2.1 Experience of the Croatian Energy RegulatoryCouncilThe Electricity Market Act of 2001 also stipulatedthat the regulatory body at the time, the CroatianEnergy Regulatory Council ∑ CERC (VijeÊe za regulacijuenergetskih djelatnosti ∑ VRED) [14], would issueprior approval for the development and constructionplans of the transmission and distribution networks.In the year 2003, the Croatian Independent Systemand Market Operator ∑ CISMO (Hrvatski nezavisnioperator sustava i træiπta d.o.o. ∑ HNOSIT d.o.o.)and HEP Transmission (HEP Prijenos d.o.o.) forwardedthe Development and Construction Plan forthe Transmission Network for the Period of 2003 to2005, and HEP Distribution (HEP Distribucija d.o.o.)forwarded the Development and Construction Planfor the Distribution Network for the Period of 2003to 2005 to the Croatian Energy Regulatory Council∑ CERC in order to obtain prior approval. Since theCERC had not previously taken a position regardingthe manner in which it would approach the issue ofprior approval for plans, it started work on the Criteriaand Methodology for Planning the Development,Construction, Replacement and Reconstruction ofTransmission and Distribution Networks, by which itattempted to determine the starting position of theregulatory body vis-à-vis the strategic developmentof the transmission and distribution networks as wellas the criteria for the reconstruction of the existingfacilities in a transparent, clear and consistentmanner. Bearing in mind that the work of the regulatorybody should be based upon the principles oftransparency, consistency and expertise, the CERCassumed the position that it is necessary to provide aclear definition to the energy entity concerning whatis expected of it so that the future positions, i.e. decisions,of the regulatory body would be predictable.This is even more important regarding investmentsin capital intensive activities, which would requirelong-term as well as medium-term analysis, i.e. thelong-term return of invested assets, as also reflectedin the amount of the tariff items.An illustrative example of the CERC's conclusionfrom the year 2003, which was the starting point fordevising the Criteria and Methodologies for Planningthe Development, Construction, Replacement andReconstruction of the Transmission Network, aswell as preparing the final modifications of the submittedDevelopment and Construction Plan for theTransmission Network for the Period from 2003 to2005, is as follows [15]:I.
