Naravno, u zemljama u kojimasu odgovarajuÊa energetska regulatorna tijelaosnovana tek nedavno, u kojima odreappleeni procesirestrukturiranja i novog organiziranja elektroenergetskogsektora nisu u potpunosti dovrπeni, ukojima je proces otvaranja træiπta elektriËne energijei uvoappleenje konkurencije tek u poËetnoj fazi, ikonaËno u kojima odgovarajuÊe makroekonomskepokazatelje i utjecajne regulatorne parametre nijenimalo lako i jednostavno utvrditi, puno je veÊibroj i pitanja i dilema. Oblik prenoπenja znanja isteËenih iskustava, kakav je uostalom ponudio iovaj Okrugli stol, ukazuje na nuænost i potrebu organizacijeistih ili sliËnih formi i sadræaja rada nanacionalnoj, regionalnoj, pa i πiroj meappleunarodnojrazini, bilo da se radi o okruglim stolovima, radionicama,seminarima ili konferencijama.3) Okrugli stol naglasio je da je bez obzira na razliËitaiskustva i dinamiku procesa, i bez obzirana opÊi zakonodavni i gospodarski sustav iz kojegdolazi, odgovarajuÊi vrijedeÊi zakonodavni okvir usvakoj dræavi mora osigurati uvjete za nezavisan,nepristran i razvidan rad energetskog regulatornogtijela. Unutar toga zakonodavnog okvira nadleænodræavno tijelo i regulatorno tijelo imaju obvezu iduænost izgraditi i primijeniti utemeljene, realne,razvidne i lako provedive mehanizme i metodologijeregulacije, odnosno metodologije tarifnih sustava.O raznim oblicima ili sadræajima, politiËkimi gospodarskim utjecajima nuæno je voditi raËunautoliko πto su oni stalno prisutni, πto su izrazi raznihnacionalnih strategija ili interesa, dakle predstavljanjuvaæan element realnog okruæja u kojemse odvija æivot i rad regulatornog tijela i reguliranihenergetskih subjekata, i u kojem se uspostavljatræiπte elektriËne energije.4) Okrugli stol naglasio je suπtinsku uvjetovanostproblema regulacije reguliranih energetskih djelatnosti,naroËito monopolnih mreænih sustavai javnih usluga dinamikom otvaranja i naËinomureappleenja træiπta elektriËne energije. Pravo pristupamreæama i pomoÊnim uslugama sustava prvo je unizu problema s kojima se treba susresti. Nemadvojbe da se pravo pristupa treba i mora ureditiunaprijed kroz odgovarajuÊa mreæna pravila itehniËke uvjete, ali da bi se moglo ostvarivati unepristranom, razvidno i nediskriminirajuÊemokruæju, nuæno je unaprijed utvrditi i objaviti itehniËke i ekonomske uvjete prikljuËka i naknadeza koriπtenja prijenosne i distribucijske mreæe, teuvjete i naknade za koriπtenje pomoÊnih uslugasustava, naravno u sluËaju da su iste obuhvaÊeneodgovarajuÊim regulatornim okvirom.5) Okrugli stol jasno je pokazao prednost u iskustvui rjeπenjima regulatornih tijela, odnosno2) The lecturers introduced the issues to the RoundTable Discussion participants and called attentionto the general presence of similar questions and dilemmasin all the countries, regulatory agencies andregulated electrical power entities. The form of the transfer of knowledgeand acquired experience, as provided at this RoundTable Discussion, indicates the necessity for organizingsimilar events at the national, regional and eveninternational levels, in the form of round table discussions,workshops, seminars or conferences.3) The Round Table Discussion emphasized that,regardless of differences in experiences and processdynamics, and regardless of the general legal andeconomic system, the appropriate valid and transparentlegal framework in each country must provideconditions for the independent, nondiscriminatoryand transparent operation of the energy regulatoryagency. Within this legal framework, the authorizedgovernment agency and regulatory agency have theobligation and duty to build and implement wellfounded,realistic, transparent and feasible regulatorymechanisms and tariff system methodologies. It isnecessary to take the various forms and contents ofthe prevailing political and economic influences intoaccount, which are expressions of various nationalstrategies or interests, i.e. they represent an importantelement of the actual environment in which theregulatory agency and the regulated electrical powerentities function, and in which the electricity marketis established.4) The Round Table Discussion highlighted an essentialcorrelation among the issues of the regulationof regulated activities, especially monopolistic networksystems and public services, in the dynamics ofthe opening of electricity markets and the manner oftheir organization. The right to access the networksand auxiliary services of the system is the first in aseries of issues that must be addressed. There isno doubt that the right to access must be definedin advance through appropriate network rules andtechnical conditions.
