There is however a very clear restriction in this connection imposed on drivers who passedtheir tests after 1 January 1997.They can only receive out of pocket expenses for their driving, and so any indication of a contract for their drivingunder which they are entitled to receive payment for it, either by way of written agreement or formal arrangement,such as being included on the union pay-roll etc would be likely to vitiate their entitlement to drive vehicles operatedunder Section 19 Permit scheme and cause both themselves and the union to commit offences in relation to theactivity. Such practices in dealing with drivers should cease, therefore, and alternative practices should be put intoplace, such as putting people who qualify onto a “Voluntary Driver Rosta” under the terms of which they will be entitledto receive only “out of pocket expenses”, which may nevertheless be fixed at an averaged flat rate.NUS North East82
