Platforms without legal or social security resp<strong>on</strong>sibilities<br />
For <str<strong>on</strong>g>the</str<strong>on</strong>g> user <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g>se services, Upwork is <str<strong>on</strong>g>the</str<strong>on</strong>g> perfect illustrati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> this radical<br />
simplificati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> <strong>labour</strong> relati<strong>on</strong>ship, described as follows:<br />
1. ‘post your project;<br />
2. choose from top talent;<br />
3. hire <str<strong>on</strong>g>and</str<strong>on</strong>g> collaborate with ease;<br />
4. pay <strong>on</strong>ly for work approved.’<br />
The same logic is applied at Uber where <str<strong>on</strong>g>the</str<strong>on</strong>g>re exists no form <str<strong>on</strong>g>of</str<strong>on</strong>g> employment<br />
c<strong>on</strong>tract for service providers: ‘Drivers get paid <strong>on</strong>ly when <str<strong>on</strong>g>the</str<strong>on</strong>g>y work <str<strong>on</strong>g>and</str<strong>on</strong>g> are<br />
resp<strong>on</strong>sible for <str<strong>on</strong>g>the</str<strong>on</strong>g>ir own pensi<strong>on</strong>s <str<strong>on</strong>g>and</str<strong>on</strong>g> health care. Risks borne by companies<br />
are being pushed back <strong>on</strong> to individuals’ (The Ec<strong>on</strong>omist 2015a).<br />
At Airbnb legal <str<strong>on</strong>g>and</str<strong>on</strong>g> social security risks <str<strong>on</strong>g>and</str<strong>on</strong>g> liabilities are even more radically<br />
cast aside. The general terms <str<strong>on</strong>g>and</str<strong>on</strong>g> c<strong>on</strong>diti<strong>on</strong>s specify that ‘you underst<str<strong>on</strong>g>and</str<strong>on</strong>g> <str<strong>on</strong>g>and</str<strong>on</strong>g><br />
agree that Airbnb is not a party to any agreements entered into between hosts<br />
<str<strong>on</strong>g>and</str<strong>on</strong>g> guests, nor is Airbnb a real estate broker, agent or insurer. Airbnb has no<br />
c<strong>on</strong>trol over <str<strong>on</strong>g>the</str<strong>on</strong>g> c<strong>on</strong>duct <str<strong>on</strong>g>of</str<strong>on</strong>g> hosts, guests <str<strong>on</strong>g>and</str<strong>on</strong>g> o<str<strong>on</strong>g>the</str<strong>on</strong>g>r users <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> site, applicati<strong>on</strong><br />
<str<strong>on</strong>g>and</str<strong>on</strong>g> services or any accommodati<strong>on</strong>s, <str<strong>on</strong>g>and</str<strong>on</strong>g> disclaims all liability in this regard<br />
to <str<strong>on</strong>g>the</str<strong>on</strong>g> maximum extent permitted by law’ (Airbnb 2015).<br />
These companies c<strong>on</strong>centrate exclusively <strong>on</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g>ir core business which c<strong>on</strong>sists<br />
in linking up supply <str<strong>on</strong>g>and</str<strong>on</strong>g> dem<str<strong>on</strong>g>and</str<strong>on</strong>g>, disclaiming all o<str<strong>on</strong>g>the</str<strong>on</strong>g>r types <str<strong>on</strong>g>of</str<strong>on</strong>g> resp<strong>on</strong>sibility<br />
or commitment. As we have seen, Upwork <str<strong>on</strong>g>of</str<strong>on</strong>g>fers <str<strong>on</strong>g>the</str<strong>on</strong>g> services <str<strong>on</strong>g>of</str<strong>on</strong>g> more than 10<br />
milli<strong>on</strong> workers but refuses to regard <str<strong>on</strong>g>its</str<strong>on</strong>g>elf as an employer. Similarly, Airbnb<br />
(or Uber) has become <strong>on</strong>e <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> largest accommodati<strong>on</strong> (or transport) services<br />
in <str<strong>on</strong>g>the</str<strong>on</strong>g> world without owning a single room (or fleet <str<strong>on</strong>g>of</str<strong>on</strong>g> vehicles), without<br />
exercising <str<strong>on</strong>g>the</str<strong>on</strong>g> least c<strong>on</strong>tractual, legal or penal liability in <str<strong>on</strong>g>its</str<strong>on</strong>g> mediati<strong>on</strong> service,<br />
<str<strong>on</strong>g>and</str<strong>on</strong>g> with a minimum <str<strong>on</strong>g>of</str<strong>on</strong>g> salaried staff. Airbnb, Uber, Upwork have no more<br />
than a few hundred direct employees.<br />
