<str<strong>on</strong>g>the</str<strong>on</strong>g> <str<strong>on</strong>g>impact</str<strong>on</strong>g> <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> digital <str<strong>on</strong>g>ec<strong>on</strong>omy</str<strong>on</strong>g> <strong>on</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> occupati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> journalist <str<strong>on</strong>g>and</str<strong>on</strong>g> <strong>on</strong><br />
working c<strong>on</strong>diti<strong>on</strong>s in this sector.<br />
3.1 The acquis <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> European social dialogue<br />
Numerous agreements have been adopted at nati<strong>on</strong>al or company level in <str<strong>on</strong>g>the</str<strong>on</strong>g><br />
wake <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> European social dialogue framework agreement <strong>on</strong> teleworking<br />
(16 July 2002), which c<strong>on</strong>tains points that can serve as a basis for reflecti<strong>on</strong><br />
<strong>on</strong> teleworking, mobile work, or distance-working.<br />
It is true that teleworking is no more than <strong>on</strong>e aspect <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> stakes that we have<br />
analysed in this study; <str<strong>on</strong>g>and</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g>re exist, what is more, major differences between<br />
<str<strong>on</strong>g>the</str<strong>on</strong>g> c<strong>on</strong>text at that time (2002) <str<strong>on</strong>g>and</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> current situati<strong>on</strong>. Back in 2002 it was<br />
a questi<strong>on</strong> above all <str<strong>on</strong>g>of</str<strong>on</strong>g> practices encountered in <str<strong>on</strong>g>the</str<strong>on</strong>g> c<strong>on</strong>text <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> traditi<strong>on</strong>al<br />
company, with a view to ‘modernising <str<strong>on</strong>g>the</str<strong>on</strong>g> organisati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> work’. As defined by<br />
<str<strong>on</strong>g>the</str<strong>on</strong>g> agreement, teleworking was to be practised in <str<strong>on</strong>g>the</str<strong>on</strong>g> framework <str<strong>on</strong>g>of</str<strong>on</strong>g> a c<strong>on</strong>tract<br />
or employment relati<strong>on</strong>ship 57 <str<strong>on</strong>g>and</str<strong>on</strong>g> this is today frequently no l<strong>on</strong>ger <str<strong>on</strong>g>the</str<strong>on</strong>g> case,<br />
in particular in digital <str<strong>on</strong>g>ec<strong>on</strong>omy</str<strong>on</strong>g> companies (management, organisati<strong>on</strong>, etc.)<br />
where <str<strong>on</strong>g>the</str<strong>on</strong>g> work is carried out by self-employed workers, freelancers, or even<br />
workers operating outside any kind <str<strong>on</strong>g>of</str<strong>on</strong>g> legal framework, i.e. <strong>on</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g><br />
‘underground’ <strong>labour</strong> market.<br />
N<strong>on</strong>e<str<strong>on</strong>g>the</str<strong>on</strong>g>less, <str<strong>on</strong>g>the</str<strong>on</strong>g>re remain a whole series <str<strong>on</strong>g>of</str<strong>on</strong>g> stakes for <str<strong>on</strong>g>the</str<strong>on</strong>g> world <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>labour</strong>. The<br />
following are some <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> important areas in which questi<strong>on</strong>s arise:<br />
<strong>—</strong> financing <str<strong>on</strong>g>of</str<strong>on</strong>g> work equipment;<br />
<strong>—</strong> installati<strong>on</strong> <str<strong>on</strong>g>and</str<strong>on</strong>g> maintenance <str<strong>on</strong>g>of</str<strong>on</strong>g> this equipment;<br />
<strong>—</strong> utilisati<strong>on</strong> costs (internet subscripti<strong>on</strong>s, telecommunicati<strong>on</strong>s);<br />
<strong>—</strong> technical support;<br />
<strong>—</strong> costs linked to <str<strong>on</strong>g>the</str<strong>on</strong>g> loss or damage <str<strong>on</strong>g>of</str<strong>on</strong>g> equipment (insurance);<br />
<strong>—</strong> resp<strong>on</strong>sibilities in relati<strong>on</strong> to health <str<strong>on</strong>g>and</str<strong>on</strong>g> safety during time spent<br />
working: sickness, accident, h<str<strong>on</strong>g>and</str<strong>on</strong>g>icap, etc.;<br />
<strong>—</strong> <strong>labour</strong> inspecti<strong>on</strong>;<br />
<strong>—</strong> working time organisati<strong>on</strong>;<br />
<strong>—</strong> workload <str<strong>on</strong>g>and</str<strong>on</strong>g> output assessment criteria;<br />
<strong>—</strong> access <str<strong>on</strong>g>of</str<strong>on</strong>g> workers to informati<strong>on</strong> c<strong>on</strong>cerning <str<strong>on</strong>g>the</str<strong>on</strong>g> company;<br />
<strong>—</strong> relati<strong>on</strong>s with colleagues;<br />
<strong>—</strong> access to training possibilities (designed, for example, to learn how to<br />
use technical equipment or to develop skills to improve <strong>on</strong>e’s<br />
performance, etc.);<br />
<strong>—</strong> respect <str<strong>on</strong>g>of</str<strong>on</strong>g> private life (to what extent are service providers ‘policed’ <str<strong>on</strong>g>and</str<strong>on</strong>g><br />
c<strong>on</strong>trolled?).<br />
57. It should be noted that <str<strong>on</strong>g>the</str<strong>on</strong>g> follow-up agreement to this report (2006) menti<strong>on</strong>s precisely<br />
that <str<strong>on</strong>g>the</str<strong>on</strong>g> definiti<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> teleworker is a questi<strong>on</strong> that has been dealt with differently in each<br />
