government contracts that tenderers<br />
provide for the fair treatment of agency<br />
and fixed term contract workers.<br />
SUPPORTED EMPLOYMENT<br />
Supported Employment Schemes also<br />
play a critical role in providing those<br />
pathways for potential workers and<br />
employees who are disadvantaged<br />
in the employment market or face<br />
challenges through disabilities.A<br />
review will be undertaken of these<br />
schemes with a view to opening these<br />
up and utilising such schemes to<br />
provide support and opportunities to<br />
those that would otherwise struggle in<br />
the competitive employment market<br />
will be undertaken.<br />
JOINT GUIDANCE NOTES<br />
We also look forward to developing<br />
and sharing a joint guidance note to be<br />
issued by the Government and Unite<br />
to employers and workers to aid the<br />
development of knowledge around the<br />
rights and responsibilities under this<br />
key area of employment legislation.<br />
THE END OF ZERO HOUR<br />
CONTRACTS<br />
A <strong>GSLP</strong> Liberal Government will consult<br />
on the mechanism for the abolishment<br />
of the abuse of zero hour contracts<br />
entirely in our economy in all sectors<br />
other than where we may agree with<br />
the Unions that they are a necessary<br />
and unavoidable requirement. These<br />
contracts were most used by the<br />
GSD administration in the context of<br />
the teaching profession, where many<br />
were kept on such contracts until they<br />
were employed by the <strong>GSLP</strong> Liberal<br />
Government in 2012. Where the<br />
employer and employee agree to a set<br />
number of hours they will be required<br />
to state those hours in the employment<br />
agreement. A Zero Hour Contract<br />
Consultation Group will be convened<br />
by a <strong>GSLP</strong> Liberal Chief Minister to<br />
work on this matter on Tuesday 12th<br />
November <strong>2019</strong> at midday, to include<br />
representatives from the Unions, the<br />
Chamber and Federation and the<br />
Ministry of Employment.<br />
TRANSFERS OF UNDERTAKINGS<br />
In order to ensure similar protection<br />
in Gibraltar for workers involved in<br />
such transfers, we will adopt a similar<br />
provision to that now included in<br />
Section 3 (1) (b) of the UK Transfer of<br />
Undertaking PE 2006.<br />
TRADE UNION RECOGNITION<br />
We will work with the Unions and<br />
the Chamber of Commerce and<br />
GFSB on the principle of Trade Union<br />
recognition, given that most employers<br />
already accept that modern Trade<br />
Union practices are as advantageous<br />
to them as to employees. We will seek<br />
to create a legislative scheme that<br />
builds on the fact that the Gibraltar<br />
Constitution already recognises the<br />
freedom of association.<br />
HEALTHY & SAFE WORKPLACES<br />
We will also work with Unions<br />
to use their expertise in areas of<br />
Health & Safety in the workplace to<br />
improve every employees working<br />
environment. We will resume work<br />
on the introduction of a Health &<br />
Safety Advisory Council which will be<br />
established before the end of <strong>2019</strong><br />
and will meet monthly in 2020 and at<br />
least quarterly every year thereafter.<br />
FAMILY FRIENDLY JOBS IN ALL<br />
SECTORS<br />
The <strong>GSLP</strong> Liberal Government has led<br />
on the introduction of family friendly<br />
policies in the public sector. We<br />
believe that it is time for this approach<br />
to pervade the private sector also. We<br />
will do this in consultation with the<br />
Unions and the Chamber and GFSB in<br />
a new Inter Ministerial Committee on<br />
Quality of Family Life in Private Sector<br />
Employment. If we are elected, a <strong>GSLP</strong><br />
Liberal Chief Minister will convene<br />
the Inter Ministerial Committee to<br />
meet, with the Unions and employer<br />
representative organisations on<br />
Thursday 14th November at 4pm at<br />
No6 Convent Place.<br />
EMPLOYEE OWNERSHIP OPTIONS<br />
We will establish the legislation for<br />
Employee Ownership Trust structures,<br />
like the John Lewis Partnership. This<br />
has been done very successfully in the<br />
United Kingdom and has allowed novel<br />
mechanisms for co-operative business<br />
models to develop.<br />
WORKERS MEMORIAL DAY<br />
& MAY DAY<br />
We will continue to be committed to<br />
celebrating Workers Day on the 1st of<br />
May. Additionally, the closest weekend<br />
to the 28th April will include a Bank<br />
Holiday, creating a long weekend, to<br />
celebrate the lives of those who have<br />
died at work and to commit learning<br />
the lessons necessary to prevent<br />
illness, injury or death in the workplace.<br />
No other party is committed to doing<br />
this. This is important for Socialists<br />
around the world and we will ensure<br />
Gibraltar continues to lead by example<br />
in this field.<br />
