In the case <strong>of</strong> the Legislature, I think it is time that we introduced a section to allow for independent candidates for members <strong>of</strong><br />

Parliament. That is to avoid a scenario like the one that was seen on 18 th <strong>of</strong> March; where some MPs were left partyless; just<br />

because they did not agree with the views <strong>of</strong> the party leaders, and it is not the party leaders who elected them in the first place.<br />

Again concerning Parliament in this country, I have a suggestion that we should introduce a section to allow for permanent<br />

continuity <strong>of</strong> Parliament. That is at any one time when we are electing MPs, tuwe tunawachagua wabunge nusu. That is we<br />

have Parliamentary elections every 2 1/2 years, if our Parliament has 220, 110 <strong>of</strong> then should go for re-election at any one time.<br />

Why? At the moment, we are hearing a debate <strong>of</strong> extention <strong>of</strong> the life parliment. That debate will not arise, and it is very<br />

democratic in that case. Also that will contribute to reducing the powers <strong>of</strong> the President in section 89.<br />

The Electoral Commission should be made independent. Commissioners should not be allowed to hold <strong>of</strong>fice for more than ten<br />

years, to avoid manupulation and also, it is time that we made our local authorities more powerful; and do away with the<br />

Provincial Administration as it was said. (I will be very brief because most <strong>of</strong> the things have been mentioned by people)<br />

There are issues on human rights. One major issue is the issue <strong>of</strong> a Kenyan passport. It is said that a passport to have as a<br />

Kenyan citizen is a privilage. If I want a passport today, I have to give a reason whey I want a passport. I thought that<br />

because I have a National ID, it is my right to have a passport. I think when they are making the issue on human rights, a<br />

passport should be made a fundamental human right.<br />

Also the issue <strong>of</strong> education should be included as a human right for all Kenyans, universal primary education should be made<br />

free for all <strong>of</strong> us; and even high school and secondary school education to be subsidized.<br />

Also the issue <strong>of</strong> health, considering that some <strong>of</strong> the diseases are threatening to wipe out the whole country like HIV and Aids.<br />

Basic health should be a human right, provided free and where not possible, heavily subsidized by taxpayers in this country.<br />

Then there should be a continous process <strong>of</strong> Constitutional <strong>review</strong> and reform, not only now that we are in the year <strong>of</strong> elections<br />

that we are rushing to make a new Constitution; but we should be having a continous process. Finally, I think we should be<br />

having the issue <strong>of</strong> a national referendum; since not all issues are suppossed to be passed by Parliament; because we know the<br />

conduct <strong>of</strong> our MPs. So I think at the end <strong>of</strong> day, when we finish the national conference <strong>of</strong> the <strong>review</strong> <strong>of</strong> this Constitution, the<br />

final say should be by a 90% referendum, to be done by all Kenyans. Thank you.<br />
