Country Comments:<br />

(1) Singapore patent 94/1141 is a registration of EP 268148 B designating the<br />

UK. Singapore registrations automatically lapse when the registered patent<br />

lapses before full term. EP 268148 B lapsed in the UK in 1993 therefore<br />

Singapore patent 94/1141 lapsed in 1993.<br />

(2) Hong Kong patent 94/1104 lapsed in December 2004.<br />

(3) From 1 June 1993 to 1 March 1994 it was possible to obtain patent<br />

protection in Bulgaria for patents granted abroad or patent applications<br />

filed abroad before 1 June 1993. The patent granted in Bulgaria on such an<br />

application will expire with the corresponding foreign patent. Bulgarian<br />

patent 60937 is a registration of EP 268148 B.<br />

(4) Between 15 May 1996 and 15 May 1997 it was possible to register a foreign<br />

patent or pending patent application in Brazil in order to obtain pipeline<br />

patent protection. The granted pipeline protection term equals the<br />

remaining term of protection in the country where the first application<br />

was filed, counted from the filing date in Brazil, but not exceeding<br />

twenty years.<br />

(5) Under the USA-Latvia Agreement on Trade Relations and Intellectual<br />

Property Rights Protection of 6 July 1994 it was possible to register<br />

European patents in Latvia providing the filing date of the European<br />

patent was between 28 February 1984 and 27 February 1991. Latvian patent<br />

5745 is a pipeline registration of EP 268148 B. The term of a Latvian<br />

patent based on a pipeline European patent is 20 years from the filing of<br />

the corresponding European application. Pipeline patents in Latvia are<br />

independent of the validity of the original patents on which they are<br />

based.<br />

(6) From 1 January 1991 until 1 January 1992 it was possible to file outside<br />

the convention year in Czechoslovakia and still claim convention priority.<br />

The term of any resulting patent is 16 years from the cited priority. From<br />

1 January 1993 Czechoslovakia ceased to exist and has been separated into<br />

two nations, the Czech Republic and the Slovak Republic. All<br />

Czechoslovakian patents and pending applications valid on 1 January 1993<br />

remain in force in both the Czech and Slovak Republics. Slovak Republic<br />

application 91/3948 was originally filed in Czechoslovakia under the<br />

transitional provisions.<br />

(10) From 26 February 1998 the duration of patents covering pharmaceuticals in<br />

Israel may be extended by up to five years.<br />

(11) Following a Proclamation of the State Intellectual property Office of<br />

China of 10 December 2001 the duration of patents granted on an<br />

application filed before 1 January 1993, and still effective on 11<br />

December 2001, was extended to 20 years from filing from 15 years from<br />

filing.<br />

(12) Portuguese patent 86130 lapsed in January 2004. A supplementary protection<br />

certificate (SPC) was granted for POSICOR in Portugal citing Portuguese<br />

patent 86130. The Portuguese Official Patent Journal quotes the SPC as
