European Chemicals Agency Opens Public
Consultation on Additions to Candidate List
On September 1, 2009, the European Chemicals
Agency (ECHA) published on its website proposals
for identification of further chemicals as Substances
of Very High Concern (SVHC). Environmental and
consumer bodies, government agencies, companies,
and also interested citizens had up until October 15,
2009 to comment upon these proposals. These comments
will be taken into consideration in deciding
whether the substances will be added to the list of
candidates for authorisation.
At the end of October 2008 the ECHA placed a candidate
list of 15 Substances of Very High Concern on its website.
Meanwhile EU and ECHA have jointly developed new
proposals for extension of the candidate list to include
additional SVHCs. Interested parties were invited to comment
on these proposals up until mid-October of this
year. Comments on hazard assessment of these chemical
substances are to be considered during the decision process
by the relevant member state committee.
If the member states unanimously agree, the substances
will be added with appropriate classification to the
candidate list. This means that all companies along the
supply chain should carefully follow the development of
the candidate list on the ECHA website to remain well
informed about additional identified candidates – because
upon publication of the candidate list companies in the
EU and in the European Economic Area are obligated to
provide information according to Article 33 of the REACH
ordinance.

Die Europäische Chemikalienagentur (ECHA) hat am
1. September 2009 auf ihrer Website Vorschläge für
die Kategorisierung weiterer Chemikalien als besonders
besorgniserregende Stoffe (SVHC) veröffentlicht.
Bis zum 15. Oktober 2009 konnten Umweltund
Verbraucherverbände, Behörden, Unternehmen,
aber auch interessierte Bürgerinnen und Bürger
diese Vorschläge kommentieren. Kommentare der
Öffentlichkeit werden bei der Entscheidung, ob ein
Stoff in die sogenannte Kandidatenliste aufgenommen
wird, berücksichtigt.
Seit Ende Oktober 2008 hat die ECHA eine Kandidatenliste
mit 15 besonders besorgniserregenden Stoffen auf
ihrer Webseite veröffentlicht. Nun haben EU und ECHA
gemeinsam neue Vorschläge zur Erweiterung der Kandidatenliste
um zusätzliche SVHC-Stoffe (Substances of Very
High Concern) ausgearbeitet. Bis Mitte Oktober konnten
diese Vorschläge von der Öffentlichkeit kommentiert werden.
Kommentare hinsichtlich der Risikobewertung dieser
chemischen Substanzen sollen vom jeweiligen Mitgliedsstaat
bei der Kategorisierung berücksichtigt werden.
Stimmen die Mitgliedsstaaten einstimmig zu, wird die
Kandidatenliste um die Substanzen mit entsprechender
Einstufung erweitert. Für alle Unternehmen entlang der
Lieferkette bedeutet das: Sie sollten die Entwicklung der
Kandidatenliste auf der ECHA Webseite sorgfältig verfolgen,
um über weitere identifizierte Kandidaten informiert
zu bleiben – denn mit der Veröffentlichung der Kandidatenliste
werden die Informationspflichten für Unternehmen
in der EU und im Europäischen Wirtschaftsraum
nach Artikel 33 REACH-Verordnung relevant.
