(ii) I am advised that the reason for the delay in this case is because the Public Prosecution Service<br />

is awaiting the evidential copies of CCTV evidence for inclusion in the Preliminary Enquiry Papers.<br />

Gerry McGeough: Legal Aid<br />

Lord Morrow asked the Minister of Justice, given the amount of legal aid awarded for Gerry<br />

McGeough’s numerous court challenges, and taking in<strong>to</strong> account that all such actions have failed,<br />

whether he will instruct that no further funding should be certified <strong>to</strong> pursue any follow-up actions; and<br />

whether he will seek a percentage, of the legal aid awarded <strong>to</strong> be re-couped from the Gerry McGeough<br />

and Family Fund which hosted appeals for donations <strong>to</strong> cover his legal fees.<br />

Mr Ford: Any future applications for legal aid from Mr McGeough will be considered on the merits, by the<br />

relevant statu<strong>to</strong>ry authority, in accordance with Article 6 of the European Convention on Human Rights.<br />

My Department has no evidence of additional funding being provided <strong>to</strong> Mr McGeough directly through<br />

the fund mentioned. If evidence were available that Mr McGeough had additional income which he<br />

failed <strong>to</strong> mention on his application for legal aid, the <strong>Northern</strong> <strong>Ireland</strong> Legal Services Commission<br />

would be in a position <strong>to</strong> commence an investigation for fraud.<br />

<strong>Northern</strong> <strong>Ireland</strong> Prison Service: Disciplinary Action<br />

Lord Morrow asked the Minister of Justice (i) on how many occasions an outside agency has<br />

recommended disciplinary action against a <strong>Northern</strong> <strong>Ireland</strong> Prison Service staff member, in each<br />

of the last five years; (ii) <strong>to</strong> detail the recommending agency in each case; and (ii) how many<br />

recommendations were approved and actioned.<br />
