Dissolution of the Department for Employment and Learning<br />
Mr Allister asked the First Minister and deputy First Minister what is the timeframe for the dissolution<br />
of the Department for Employment and Learning; and when the legislation will be introduced.<br />

Mr P Robinson and Mr M McGuinness: These matters remain under consideration. The <strong>Assembly</strong> will<br />
be advised through the relevant Committees of our decision in due course.<br />
Adverse Findings by the Commissioner for Public Appointments<br />
Mr Allister asked the First Minister and deputy First Minister what steps are proposed for imposing<br />
sanctions in the event of adverse findings by the Commissioner for Public Appointments, as<br />
recommended by the Public Accounts Committee.<br />

Mr P Robinson and Mr M McGuinness: The functions and powers of the Commissioner for Public<br />
Appointments are set out in the Commissioner for Public Appointments (NI) Order 1995. We have no<br />
plans <strong>to</strong> change the current functions and powers of the Commissioner.<br />
Alleged Breaches of the Ministerial Code<br />
Mr Allister asked the First Minister and deputy First Minister what mechanisms exist <strong>to</strong> deal with<br />
alleged breaches of the Ministerial Code, including how they are investigated and by whom.<br />

Mr P Robinson and Mr M McGuinness: The Ministerial Code does not specify any procedure <strong>to</strong> be<br />
followed in relation <strong>to</strong> the investigation or determination of breaches of the Ministerial Code, nor does it<br />
assign any role <strong>to</strong> us in the matter. Section 28A of the <strong>Northern</strong> <strong>Ireland</strong> Act 1998 requires Ministers <strong>to</strong><br />
act in accordance with the provisions of the Ministerial Code and any alleged breach of the Code could<br />
be decided as a matter of law.<br />
In addition, the <strong>Northern</strong> <strong>Ireland</strong> Act makes provision for failure by a Minister <strong>to</strong> observe the terms of<br />
the Pledge of Office <strong>to</strong> be the subject of a motion for a resolution of the <strong>Assembly</strong>. Such a motion can<br />
be moved jointly by us, or by an MLA with the support of 29 other Members.<br />
Alleged Breaches of the Ministerial Code<br />
Mr Allister asked the First Minister and deputy First Minister whether they have any plans <strong>to</strong> review the<br />
mechanisms that exist <strong>to</strong> deal with alleged breaches of the Ministerial Code.<br />

Mr P Robinson and Mr M McGuinness: We have no plans for such a review. Apart from the courts, the<br />
ultimate authority for breaches of the Ministerial Code resides with Members and the <strong>Assembly</strong>.<br />
Funding for Towards Understanding and Healing<br />
Mr Eastwood asked the First Minister and deputy First Minister why the funding for Towards<br />
Understanding and Healing from SEUPB under ‘Theme 1.2 Acknowledging and Dealing with the Past’<br />
has not been released, given that the funding has been approved by the Steering Committee and the<br />
Pre Contract Check has been completed.<br />

Mr P Robinson and Mr M McGuinness: The project application in respect of ‘Towards Understanding<br />
and Healing’ was submitted under Peace III Theme 1.2 Dealing with the past. SEUPB has delegated the<br />
administration of this theme <strong>to</strong> the Consortium comprising the Community Relations Council (CRC) and<br />
POBAL.<br />
