2. In the process of news gathering a reporter collects information from<br />

various sources and owes an obligation in relation to those who do not wish<br />

to be identified. In the absence of an undertaking to respect such<br />

confidentiality it may become impossible to perform the public duty owned<br />

by the Press; and<br />

3. That the freedom of the Press guaranteed by the Constitution might<br />

become illusory unless protection against disclosure is afforded to journalists<br />

in the same manner as it is afforded to lawyers, doctors and public servants. I<br />

am informed that such privilege of journalists is lately being recognised in<br />

many legal systems on grounds of public policy.<br />

The tribunal did not accept the plea advanced by him and afforded one more<br />

opportunity to him on Tuesday to state any law in Pakistan which provides<br />

privileges which he is claiming, not to divulge his source of information. He<br />

will appear before the tribunal at 12-noon on Tuesday with his counsel.<br />
