SINDH GOVT RECONSTITUTES TRIBUNAL<br />

KARACHI, Sept 25, 1996: Sindh Government Wednesday notified the reconstitution<br />

of the Tribunal of Inquiry to inquire into the firing incident<br />

resulting in the death of Mir <strong>Murtaza</strong> <strong>Bhutto</strong> MPA and seven others and<br />

injuries to six persons on September 20. The Tribunal constituted in<br />

consultation with the Chief Justice of Sindh High Court now comprises Mr.<br />

Justice Ali Mohammed Baluch, President, Mr Justice Amanullah Abbasi and<br />

Mr. Justice Dr Ghous Mohammed as its members, according to the<br />

notification issued by Home department tonight. According to the<br />

notification the terms of reference of the Tribunal will be:<br />

(a) To enquire into and determine the circumstances leading to the<br />

incident of firing in which the death of Mir <strong>Murtaza</strong> <strong>Bhutto</strong> MPA<br />

Sindh and seven others were caused and six injured.<br />

(b) To enquire into the justification for posting of a heavy police picket<br />

near 70-Clifton, Karachi, the residence of Mir <strong>Murtaza</strong> <strong>Bhutto</strong>, MPA,<br />

Sindh, at that particular time and that particular day.<br />

(c) To determine whether the police party had the lawful justification<br />

to fire upon Mir <strong>Murtaza</strong> <strong>Bhutto</strong>, MPA Sindh and his party.<br />

(d) To determine whether the incident of firing upon Mir <strong>Murtaza</strong><br />

<strong>Bhutto</strong> and others could have been avoided by exercising proper care<br />

and caution.<br />

(e) To determine as to whether there was any delay in giving medical<br />

aid to Mir <strong>Murtaza</strong> <strong>Bhutto</strong> and others, if so, to fix the responsibility for<br />

the lapses.<br />

(f) To determine whether the incident occurred without any<br />

provocation from the side of Mir <strong>Murtaza</strong> <strong>Bhutto</strong> and his companions<br />

and even if there was any provocation whether the police party used<br />

excessive force.<br />

(g) To determine whether the incident was preplanned and whether<br />

the whole operation was carried out to cause the intentional death of<br />

<strong>Murtaza</strong> <strong>Bhutto</strong>; Copyright © www.bhutto.org<br />
