Q: When were the cases transferred to the Crimes Branch?<br />

A: On December 15, 1996. They were not transferred but I was suspended and<br />

I handed over the charge on Dec. 16. I served from Sept 23 to Dec. 15.<br />

Q: While you were involved in investigations did you come to know that<br />

pictures of the site were taken.<br />

A: When the papers were handed over to me there were no pictures. And on<br />

Oct. 7 the SHO Clifton had sent 13 photos to me and they were of the trees<br />

supposed to have been hit by gunshots as was maintained by the police<br />

station.<br />

Later, when the matter was brought to the notice of the police, we went to the<br />

site to match the photos with the marks on trees, with the permission and<br />

concurrence of the DIG. They were not consistent with bullet marks, therefore<br />

we returned them on Oct. 10 to Clifton PS.<br />

Q: Other than those pictures, were you told about some other pictures?<br />

A: The pictures were not seen by me before. I am seeing them here for the<br />

first time. They were not taken on the same night but in daylight. I had called<br />

for the statement of sub-inspector Khurram Waris recorded under Section 161<br />

CrPC. He did not mention it and Shukaib Qureshi had also not mentioned the<br />

pictures.<br />

The pictures of the trees, according to my opinion, were marked by a knife,<br />

nail or metal object on the trees on the side of Clifton Garden. Rai Tahir had<br />

also not discussed about the pictures.<br />

The fourth witness was DSP Saeed Ahmed Khan of the Crimes Branch.<br />

Q: Sub-inspector Waris had said you had seen those pictures taken of the<br />

vehicles with gunshots?<br />

A: I am seeing them for the first time. I never went to Clifton PS and I had not<br />

met him at JPMC on second or third day of the incident to collect inquest<br />

reports and he had been coming to the Crimes Branch for recording his<br />

statements.<br />
