The final challan will be on the basis of the FIR of Noor Mohammad which<br />

was registered by the police on the direction of the High Court of Sindh. He<br />

said investigations were not complete and were still going on. The AIG said<br />

his son, Zafar Ali Mithiani, is serving as a DSP and was suspended by the<br />

previous IG of Police but has been reinstated in the same position. The<br />

witness said he was reinstated before his appointment as investigation officer<br />

in the case. He was reinstated without any inquiries against him. Akhtar Ali<br />

G. Kazi also produced a copy of the FIR registered in Larkana on the firing at<br />

Al-<strong>Murtaza</strong> on Jan 5, 1994.<br />

Earlier, the senior counsel had also been asked to submit before the tribunal a<br />

copy of the report of a judicial inquiry intothe incident in which four people<br />

were killed in police firing at Al-<strong>Murtaza</strong> in Larkana. He said the judicial<br />

inquiry was conducted by Dargahi Mangi, a district and sessions judge, who<br />

had sent the copy of his report to the government of Sindh which could not<br />

been traced and neither it was published then. On this, the chairman of the<br />

tribunal remarked that he had also conducted a similar exercise in 1994 on the<br />

Shia-Sunni riots in Liaquatabad and it was also submitted to the government<br />

and there was no trace of that too. It was a 153-page report. The chairman<br />

said at the time when he was inquiring into the incident, he wanted to see an<br />

earlier report by Justice Dr I. Mahmood, which was also not available.<br />

Khwaja Sharful Islam suggested to the tribunal that the written arguments<br />

might be allowed to be filed which would save the time of the tribunal as well<br />

as the counsel's and the documents might become part of the record, to which<br />

Justice Zahid said it was a good idea and if anybody wanted to file written<br />

arguments, he was welcome. The tribunal would start hearing arguments on<br />

Wednesday at 11:30 am.<br />
