Tender for Road Transportation of Bulk POL products: MS<br />

/HSD and Branded fuels<br />

SD shall be paid either in the form of Demand Draft or Bank Guarantee. The DD shall be<br />

drawn on any Scheduled Bank (other than co-operative bank) in favour of Hindustan<br />

Petroleum Corporation Ltd. payable at PANIPAT. Bank Guarantee shall be strictly in<br />

specified proforma, valid for six months beyond the maximum possible tenure of the<br />

contract.<br />

2. Adjustment of EMD towards SD is <strong>no</strong>t permissible. Cash receipts for SD paid by DD will be<br />

issued by the Oil Company.<br />

3. Interest is <strong>no</strong>t payable on SD.<br />

4. Any loss/ claim and/ or damage arising out of the performance of the contract would be<br />

adjustable against the SD. Any loss/ claims/ damages higher than SD will be recovered<br />

from payments due to the contractor under this contract or deposits made by or payments<br />

due to the contractor under any other contract with the Oil Company.<br />

5. Security deposit would be refunded after expiry of six months of completion of the contract<br />

on written request from the contractor and with surrender of the original cash receipt,<br />

subject to satisfactory performance. In the event of loss / misplacement of the cash receipt<br />

of the SD, the refund would be made only after the contractor furnishes an Indemnity Bond<br />

in the prescribed proforma, on <strong>no</strong>n-judicial stamp paper of appropriate value (at<br />

contractor’s cost), duly <strong>no</strong>tarized.<br />

6. Separate SDs are to be submitted for each location.<br />

7. Successful <strong>tender</strong>er will be entrusted with transportation work only after signing of<br />

Agreement and payment of Security Deposit amount.<br />

18. Contract Period and Rate Escalation:<br />

(a). The contract is awarded for a period of 5 (Five) years w.e.f. 01.07.<strong>2012</strong>.<br />

(b). The rates would come into effect from the date of signing of the contract<br />

(c) The Escalation /De-escalation on account Increase / decrease in price of Diesel fuel<br />

shall be applicable as given in Schedule- A & B.<br />

(d) The Corporation shall endeavour to finalise contract for the next tenure before the<br />

Expiry of the existing Contract Period. However if the new contract is <strong>no</strong>t tfinalized<br />

before the expiry of the existing contract, Corporation reserves the right to extend the<br />

existing contract beyond the period of five years, and upto a maximum of six months on<br />

adhoc basis and continue utilizing the tank trucks for making supplies.<br />

During the period of adhoc operation, the transportation rates, terms and conditions as<br />

per the existing contract agreement shall be applicable including the Escalation /Deescalation<br />

on account Increase / decrease in price of Diesel fuel, as given in<br />

Schedule- A & B.<br />

(d). A one time Increment of 5% of the Non-fuel Component of the rate, shall be granted<br />

at the end of the 3 rd year of the contract described as under:<br />

(i) The <strong>no</strong>n-HSD component of the rate (the finalized rate less the corresponding HSD<br />

component) <strong>no</strong>t exceeding 60% of the finalized rate, shall be considered for the<br />

escalation, as illustrated in Schedule C.<br />

(ii) The revised rate would take effect from the beginning of the 4 th year of the contract.<br />
