Summary of Conclusions<br />

• Encourage wider adoption of voluntary industry initiatives both in the U.S. and around the<br />

world, as part of a multi-pronged approach to reduce the harm caused by illegal activities of<br />

PFWs.<br />

The IPL Section also considered several additional areas, and has provided substantive research<br />

within this White Paper to address those areas, but did not reach any conclusions about potential<br />

resolutions in those areas. Nonetheless, the IPL Section recommends that Congress undertake factfinding<br />

through hearings or other public fora to consider the following issues and determine the<br />

most effective (yet least restrictive with respect to existing U.S. individual rights and existing IP<br />

law) solution to include in any legislative proposal:<br />

• Whether additional incentives could be identified or implemented to encourage a broader<br />

adoption by U.S.-based Internet businesses of voluntary actions to stem illegal pirating or<br />

counterfeiting by PFWs; and<br />

• Whether additional civil or criminal remedies are warranted with respect to any U.S.-based<br />

entities that participate in the channel(s) of distribution of pirated copyrighted content or<br />

counterfeit goods by PFWs.<br />

The IPL Section trusts that Congress will take the analysis and recommendations presented in this<br />

White Paper and give due consideration to crafting legislation that balances the competing<br />

interests and finds a way to help U.S. intellectual property rightsholders defend their rights against<br />

incursion by PFWs.<br />
