Legal accident insurance
The legal accident insurance is responsible for consequences arising from work accidents
and accidents happening on the way to work as well as occupational illnesses. Contrary to the other four
systems of the social security scheme the contributions to the accident insurance are paid only by the
employer. However, according to the law, not only are all employees and those in training insured in the
case of accidents, but also children, pupils and students on their way to work and during visits to childminding
institutions and training facilities. Independent persons who are not members or contributors of
the obligatory insurance have the possibility of voluntarily contributing to an accident insurance.
Foreign employees, who suffered an industrial accident and are entitled to accident benefits, also receive
these in their homeland from the German insurer. If a foreign employee suffers death in an industrial
accident, his survivors receive a pension even if they live in their homeland. The same conditions are
valid for German employees who work in other European states.
Since the legal accident insurance scheme does not offer protection for accidents which happen in a
person’s time off work and within the household, anyone can additionally register with a private accident
insurance company.
