Permits are required for each type <strong>of</strong> mining activity (e,g. minimal impact<br />

New Mexico Oil Conservation Division Regulations<br />

The Oil Conservation Division (OCD) <strong>of</strong>lhe New Mexico Energy, Minerals, and<br />

Natural Resources <strong>Department</strong> administers the laws and regulations relating to oil, gas,<br />

and geothermal resources under the authority <strong>of</strong> the New Mexico OCD Regulations<br />

(NMSA Part 70-2-1 et seq. and the Geothermal Resources Conservation Act (NMSA Part<br />

71-5-1) and Water Quality Act (NMSA Part 74-6-1 et seq). The OCD Regulations have<br />

been codified in the NM OCD Rules and Regulations adopted March 1, 1993,<br />

The OCD has jurisdiction and authority over all matters relating to oil and gas and<br />

prevention <strong>of</strong> associated waste and the protection <strong>of</strong> oil, gas, geothermal water, or other<br />

fresh waters. The OCD enforces the provisions <strong>of</strong> the OCD Regulations. The OCD is<br />

also charged with nrotecting fresh water. OCD, as a general rule, lIdministers and<br />

enforces applicable regulations penaining to bOth surface and ground-water discharges at<br />

oil and gas drilling and production sites, oil refineries, natural gas processing plants,<br />

geothermal installations, carbon dioxide facilities, oil and natural gas pipelines, compressor<br />

stations, and oil field services.<br />
