Operations that involve subsurface mining or the extraction <strong>of</strong> oil, gas, or potash<br />

and that use or dispose <strong>of</strong> polychlorinated biphenyls (PCB) would be subject to regulations<br />

as described in 40 CFR Part 761, including the following:<br />

• Manufacturing, processing, distribution in commerce, and use <strong>of</strong> PCBs and PCB<br />

items (Subpart B)<br />

• Marking <strong>of</strong> PCBs and PCB items (Subpart C)<br />

• PCB spill cleanup policy (Subpart G)<br />

• General recc 'd reports (Subparts 1)<br />

• PCB waste disposal records and reports {Subpart K)<br />

Permits. special reports. and fees<br />

No permits or fees are associated w',h 40 CFR Part 761. Users <strong>of</strong> PCJ" or<br />

products containing PCBs would need to meet reporting requirements described in 40<br />

CFR Part 761.<br />

WIPP Land Withdrawal Act<br />

The <strong>Waste</strong> <strong>Isolation</strong> <strong>Pilot</strong> <strong>Plant</strong> (WlPP) Land Withdrawal Act restricts the mining<br />

<strong>of</strong> minerals and exttaetion <strong>of</strong> oil or gas on the withdrawn land and within 1 mi <strong>of</strong> the<br />

withdrawn land boundary at any time (including after the decommissioning <strong>of</strong> the WIPP<br />

Site), in order to protect the integrity <strong>of</strong> the disposal system.<br />

The Land Withdrawal Act, Public Law 102-579, was enacted on October-30,<br />

1992, to transfer the land under and around the WIPP site from the Bureau <strong>of</strong> Land<br />

Management (BLM) to the <strong>Department</strong> <strong>of</strong> Energy (DOE). The Land Withdrawal Act<br />

reserves the withdrawn land for authorized activities associated with the WIPP Project.<br />

All subsurface mining for minerals or extraction <strong>of</strong> oil or gas (including slant<br />

drilling from outside the boundaries <strong>of</strong> the withdrawal area) is prohibited on the withdrawn<br />

land, with two exceptions. These exceptions are two 32D-acre tracts <strong>of</strong> land within
