Pennits. special reports. and fees<br />

The following permits, special reports, and administrative fees may be required<br />

for hazardous waste generators or TSD facilities:<br />

• If a TSD facility is not operating under interim status (Part 270.70 to 270.73), a<br />

permit would be required for the treatment, storage (i.e. storage exceeding 90<br />

days), or disposal <strong>of</strong> hazardous waste. These pennitrequirements are found in<br />

Part 264.<br />

• The following reports may be required:<br />

Biennial report (Part 262.41 for generator facilities (Part 262.41), for<br />

permitted TSD facilities (Part 264.75), and for interim-status TSD facilities<br />

(part 265.75<br />

Exception report for generator facilities (part 262.55)<br />

Unmanifested waste report for permitted TSD facilities (Part 264.76) and<br />

for interim-status TSD facilities (Part 265.76).<br />

An annual report (Part 262.56) and exception report (part 262.55) for<br />

generator facilities, if the hazardous waste is exported to another country<br />

If required by the regulator, additional reports for generator facilities (Part<br />

262.43), for permitted TSD facilities (Part 264.77), and for interim-status<br />

TSD facilities (part 265.77)<br />

If hazardous waste is placed in a land-based TSD unit (i.e. landfill, surface<br />

impoundment, land treatment facility), certain groundwater monitoring and<br />

reporting requirements must be met for permitted TSD units (parts 264.90<br />

to 264.100) and for interim-status TSD units (parts 265.90 to 265.94).<br />

The federal regulations do not require administrative fees. However, the New<br />

Mexico Environment <strong>Department</strong> does assess administrative fees for new permits and<br />

permit revisions (see New Mexico Hazardous <strong>Waste</strong> Acr).<br />
