NEPA regulations, codified in 40 CFR 1501-1508, include the following:<br />

Predecision referrals <strong>of</strong> federal actions determined to be environmentally unsatisfactory<br />

!part 1504)<br />

NEPA and agency decision making (part 1505)<br />

Agency compliance (Part 1507)<br />

Some federal agencies have issued their own regulations for complying with<br />

NEPA, such ,il' the National Environmental Policy Act Compliance Program (DOE Order<br />

5440.1E, issued in 1992), which provides compliance regulations for DOE-controlled<br />

lands; and 43 CFR Subchapter A, Subpart 1601 et seq. (1983), which provides compliance<br />

guidance for BLM-controlled lands.<br />

Operations that are involved in subsurface mining or the extraction <strong>of</strong> oil, gas, or<br />

potash may be subject to requirements for evaluating the effect <strong>of</strong> the operations on the<br />

environment, unless the action was determined to be categorically excluded (40 CFR<br />

1508.4).<br />

Pennits. special reports, apd fees<br />

No permits or fees are associated with NEPA. Depending on the effect <strong>of</strong> the<br />

proposed action, an environmental assessment or an environmental impact statement may<br />

be required.<br />

National Historic Preservation Act<br />

The National Historic Preservation Act (16 USC sec, 470 et seq) was enacted in<br />

1966 and has been amended several times, most recently in 1980. This act protects<br />

cultural resources in the United States and requires federal agencies to recover and<br />

preserve historic and archaeological data that would otherwise be lost during federal<br />

COL3!IUCtion or other activities.<br />
